Open from 6-22-82~ 7-13-82~ 7-27-82, and 10-12-~) <br /> Mr. Harris presented his report (SR 82:450) dated November 1, 1982, regarding this <br /> matter. He stated he felt this public hearing has been properly noticed and a decision <br /> needs to be made with regard to zoning to bring it into conformance with the General <br /> Plan. <br /> <br /> Mayor Butler declared the continued public hearing open on the application and the <br /> negative declaration. <br /> <br /> No one in the audience spoke in favor of this item. <br /> <br /> The following persons spoke in opposition to this item: <br /> <br /> Mr. Richard Logan, 1330 Broadway, Oakland, representing the Roman Catholic Bishop, <br />presented a letter to Council from the Diocese of Oakland dated November 4, 1982, <br />transmitting background information regarding the church property. He stated he did <br />not feel the Church had been properly notified, and that there was an error in the <br />first public hearing regarding the church property being excluded from the property <br />under consideration. He stated he had talked to Mr. Swift of the City Attorney's <br />office, who assured him that the application had been properly noticed. Mr. Logan <br />stated he does not know if the public hearing notice was legally adequate, but did <br />not feel it was fair because the notice was misleading. He requested Council to re- <br />hear the application from the General Plan amendment stage. <br /> <br /> Mr. Clem Finney, Architect for the Roman Catholic Diocese, 2900 Lakeshore, Oakland, <br />stated that if there is no urgency he would ask Council to reconsider the General Plan <br />amendment for this property. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on the application and the negative declaration. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Wood, to refer the 13 acres of land located on the south side of Bernal Avenue <br />extension between the eastern side of the right-of-way of the Western Pacific Railroad <br />Company and the eastern side of the right-of-way of the Southern Pacific Transportation <br />Company and the approximately 16 acres adjacent and to the south for a total of approxi- <br />mately 29 acres, back to the Planning Commission for consideration of a new General Plan <br />amendment, and to be brought back to Council at their meeting of December 13, 1982, <br />8:00 P.M., in the Pleasanton Council Chambers. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />AB SENT: None <br /> <br /> Mayor Butler recessed the meeting at 10:55 P.M. <br /> Mayor Butler reconvened the meeting at 11:00 P.M. <br /> <br />MATTERS CONTINUED FOR DECISION <br />Adoption of Ordinance No. 1056, approving the application of Ken Earp~ et al~ for <br />Planned Unit Developme.n.t. (PUC),development plan approval for an approximately 238 <br />Unit manufactured housing project for an approximately 29 acre site located on the <br />north side of Vineyard Avenue opposite Sauterne Way <br />(Intro ..10-26-82 ~ 3-Ayes ~ 2-Noes) <br /> Mayor Butler stated that Ordinance No. 1056 was introduced on October 26, 1982, <br />by a vote of 3-Ayes, 2-Noes, and that it was now in order to adopt the ordinance. <br /> <br /> 9. 11/9/82 <br /> <br /> <br />
