295 <br /> <br /> After considerable discussion, Council took the following actions: <br /> <br /> It was moved by Mayor Butler, and seconded by Councilmember Mercer, that Resolution <br />No. 82-440, with regard to Growth Management Program fees, that payment of fees be re- <br />quired within ninety (90) days from the date of small project approval unless a tenta- <br />tive map is filed within that period, in which case fees will be required thirty (30) <br />days after approval of tentative map approval; and staff is directed that to the extent <br />practical, that draft long term agreements shall reflect the same rules that are applied <br />to small project approvals, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by Mayor Butler, that Ordinance <br />No. 1057, to be read by title only and waiving further reading thereof, amending the <br />Growth Management Program as follows to add: <br /> <br /> "Section 2-20.05 (b) (10) Subsequent Modification. <br /> <br /> Once a project has received growth management approval pursuant to this section, <br /> subsequent modification of approved plans will be permitted without voiding that <br /> growth management approval under the following circumstances - <br /> <br /> (i) All other required approvals as set forth in Section 5 must be obtained <br /> for the modified plan <br /> <br /> (ii) Lapse of growth management approval for the original number of units will <br /> occur on the same date as for the original growth management approved plan <br /> in accordance with Section 9 <br /> <br /> (iii) If the number of units in the modified plan exceeds the number of units in <br /> the original approved plan, then a separate growth management approval must <br /> be obtained for the additional Units." <br /> <br />be introduced. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Mayor Butler <br />NOES: Councilmembers Mercer and Wood <br />ABSENT: None <br /> <br />PUBLIC HEARINGS <br />Application of Harris Realty and Mildred Vallarino for Planned Unit Development (PUD) <br />development. Open from 10-26-82) <br /> Mr. Harris presented his report (SR 82:415) dated October 18, 1982, regarding <br />this matter. <br /> <br /> Mayor Butler declared the continued public hearing open on the application and <br />the negative declaration. <br /> <br /> Mr. Mike Harris, applicant, stated the reason he is asking for the increase in <br />units is because in his experience as a realtor he finds there is a better market at <br />this time in Pleasanton for rentals rather than for buyers.
