169 <br /> <br />project in the City; that the density is 167% in excess of the Hillside Planned <br />Development ordinance; that it is in direct violation to the Hillside Planned <br />Development ordinance; the project is poorly designed; will require massive grading <br />and paving, adversely impact the terrain and trees; the density is too high for the <br />percentage of slope; the project doubles the risk of sliding and quake; the roadway <br />jeopardizes the existing homes; the project is badly engineered; can see the homes <br />from the City; and is not good planning. Mr. Henderson stated that the Castlewood <br />project has been awarded less open space and far more lots than under any planning <br />policy before, and this creates an absurd burden to neighboring property owners. <br />He added he felt this project should have been considered under the guidelines of <br />the Hillside Planned Development ordinance rather than Planned Unit Development. <br />Mr. Henderson took exception to the opinion of the City Attorney that referendum was <br />the appropriate remedy, and stated he felt there could be legal recourse regarding <br />approval of this project. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes, that <br />Ordinance No. 1050, approving the application of Castlewood Properties, Inc., for <br />Planned Unit Development zoning and development plan approval for an approximately <br />48 acre site for the development of 23 parcels for single-family residential use, <br />located northwest of the intersection of Foothill Road and Bernal Avenue, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br />Actions Taken by the Design Review Board and Plannin~ Commission at their meetin~ <br />of 9-21-82 <br /> Mr. Harris presented his report (SR 82:383) dated September 22, 1982, regarding <br />this matter for the information of the Council.
