He <br />stated this requires a public hearing and that letters of notification have been <br />transmitted to all property owners, and that two written requests to appear had been <br />[] received. Mr. Nave presented an aerial map showing the amended realignment of John- <br />[] son Drive. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> Mr. Tom Terrill, representing Reynolds and Brown, stated this is a procedural <br /> step. He urged Council to approve the amendment in order that the realignment im- <br /> provements may be started as soon as possible. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing <br /> -- closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, that <br /> Resolution No. 82-391, amending the Resolution of Necessity on the realignment of <br /> Johnson Drive west of Hopyard Road, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br /> NOES: Councilmember Wood <br /> ABSENT: None <br /> <br /> MATTERS CONTINUED FOR DECISION <br /> AdOption of Ordinance No. 1050~ a~Dprovin~ the..app~ication of Castlewood Properties~ <br /> INC., for Planned Unit Devel~ment~zonin_~ and development plan approval for an <br /> approximately 48 acre site for the development of 23 parcels for single-family <br /> residential use, located northwest of the intersection of Foothill Road and Bernal <br /> Avenue <br /> (Intro. 8-24-82, 4-Ayes, 1-No; R~-Intro. 9-14-82~_ 4-Ayes, 1-No) <br /> M~yor Butler stated that Ordinance No. 1050 was introduced on August 24, 1982, <br /> by a vote of 4-Ayes, and 1-No, and reintroduced on September 14, 1982, because of <br /> a modification to the lot change, the vote being 4-Ayes, 1-No, and it was now in <br /> order to adopt the ordinance. <br /> <br /> Mr. Lee Henderson, 2870 Foothill Road, read from an article in the Times dated <br /> September 24, 1982, regarding the Hacienda lawsuit that stated the opponents had not <br /> been in attendance to present their arguments. He stated he was here to avoid the <br /> argument that he failed to show up to present his argument against the Castlewood <br /> Properties project.
