189

MINUTES
of
THE MEETING
of
TttE CITY COUNCIL

September 28, 1982

CALL TO ORDER
Mayor Robert Butler called the Regular Meeting of the City Council to order at
8:00 P.M., and then led the Pledge of Allegiance to the flag.

ROLL CALL
Deputy City Clerk Doris George called the roll which is recorded as follows:
Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler were present. Mr.
Walker, City Manager, Mr. MacDonald, City Attorney, Mr. Warnick, Director of Public
Works and Utilities, and Mr. Harris, Director of Planning and Community Development,
were present.

AGENDAAMENDMENTS
Mr. Walker requested that an item be added to the Consent Calendar as follows:

item 4s - Acceptance of Easements from Hansen/Mix - Water Pipeline.

~. Walker stated that item 4n is being amended to add an Indemnity and Hold
Harmless Agreement in favor of the City of Oakland for motorcycle training for
Police Officer Bill Reynolds.

Mr. Walker stated he had received a request from Reynolds and Brown to remove
from the Consent Calendar item 41 - Acceptance of Public Improvements for Tract 4889,
Valley Business Park, and move it to item 12e on the agenda for discussion.

Mr. Walker advised there would be an Executive Session held at the conclusion
of this meeting to discuss pending litigation.

Mayor Butler stated that he had received a request to move item 13c - Resolution
amending Resolution of Necessity on Realignment of Johnson Drive west of Hopyard Road,
to be considered after Public Hearings on the agenda. Council concurred.

Councilmember Mercer asked if the motion made on September 14, 1982, as shown in
the Minutes, approving the Quail Creek Immobile Home Project for affordable housing
status, was valid in its list of necessary findings. Councilmember Mohr clarified
that her motion was intended to include findings. The City Attorney advised the
findings shown in the motion were those set forth at the meeting, that they are
sufficient under the requirements of the law, and that they satisfied the require-
ments of city ordinances.

CONSENT CALENDAR
It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that the
following items listed on the Consent Calendar, as amended thereto, be approved:

a.
