87 <br /> <br />MATTERS CONTINUED FOR DECISION <br />Adoption of Ordinance No. 1050, approving the application of Castlewood Properties, <br />Inc.~ for Planned Unit DevelOpment zoning and development plan approval for an <br />~pproximately 48 acre site for the development of 23 parcels for single-family <br />residential use~ located northwest of the intersection of Foothill Road and Bernal <br />Avenue <br /> (Intro. 8-24-821 4-A~es~ 1-No) <br /> Mr. Harris presented his report (SR 82:360) dated September 9, 1982, regarding <br />this matter, and stating that the.development plan has been revised as a result of <br />the action taken by Council on August 24, 1982, by eliminating all common open space <br />and one of the lots in the area south of Deer Oaks Drive and immediately west of <br />Foothill Road. He advised that some of the conditions of approval of the case have <br />been modified to reflect these changes, therefore, the ordinance will have to be re- <br />introduced. <br /> <br /> Mr. Art Dunkley, representing Castlewood Properties, Inc., presented his letter <br />dated September 8, 1982, elaborating on the modification to eliminate a lot in the <br />area of Lot 18 rather than one in the area of Lots 1 through 4, and requesting con- <br />sideration of this revised Deer Oaks plan. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that <br />Ordinance No. 1050, approving the application of Castlewood Properties, Inc., for <br />Planned Unit Development zoning and development plan approval for an approximately <br />48 acre site for the development of 23 parcels for single-family residential use, <br />located northwest of the intersection of Foothill Road and Bernal Avenue, with re- <br />vised modifications to eliminate a lot in the area of Lot 18 rather than in the area <br />of Lots 1 through 4, be reintroduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, and Mayor Butler <br />NOES: Councilmember Wood <br />ABSENT: None <br /> <br />Adoption of Ordinance No. 1051s approv~n~ the ~pplication of the City of Pleasanton <br />to amend Article 8~ and related portions of Chapter 21 Title II of the Ordinance <br />Code of the City of Pleasanton. to further define reSulations related to outdoor <br />sales <br />(Intro. 8-24-82~... 4-Aye. s~ 1-~0)' <br /> Mayor Butler stated that Ordinance No. 1051 was introduced on August 24, 1982, <br />by a vote of 4-Ayes, 1-No, and that it was now in order to adopt the ordinance. <br /> <br /> It was moved by Mayor Butler, and seconded by Councilmember Wood, that Ordinance <br />No. 1051, approving the application of the City of Pleasanton to amend Article 8, <br />and related portions of Chapter 2, Title II of the Ordinance Code of the City of <br />Pleasanton to further define regulations related to outdooe sales, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmember Wood and Mayor Butler <br />NOES: Councilmembers Brandes, Mercer, and Mohr <br />ABSENT: None <br /> <br /> The ordinance failed because of the above vote. <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br /> 12. 9/14/82 <br /> <br /> <br />
