175 <br /> <br /> The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: CounciLmember Brandes <br /> <br />Request for Annexation - 78 Acres at the north end of Martin Avenue (The Jordan <br />Group) <br /> Mr. Warnick presented his report (SR 82:280) dated July 21, 1982, regarding <br /> this matter. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Mohr, instructing staff to prepare a formal resolution and application to <br />LAFCO requesting the annexation of 78 acres at the north end of Martin Avenue owned <br />by the Jordan Group if permission is obtained from the two additional land o~mers, <br />and requiring the applicant for this annexation to have an acceptable legal des- <br />cription and map of the proposed annexation (meeting LAFCO standards) prepared by <br />a licensed civil engineer or land surveyor and to pay the LAFCO processing fee and <br />the State Board of Equalization fee. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, and ~yor Butler <br />NOES: Councilmember Wood <br />ABSENT: Councilmember Brandes <br /> <br />Matters for the Information of the Council <br /> Mayor Butler presented the Information Report of the Director of Planning and <br />Community Development (IR 82:21) dated July 21, 1982, regarding relocation of the <br />Fair Midway, stating that in all probability it will never be moved, but if it <br />should be, it would be relocated some 350 to 400 feet to the north toward the <br />horse barn area. <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Denial of Claim of Michael Cochran <br /> Mr. MacDonald presented his report (SR 82:265) dated July 9, 1982, regarding <br />this matter. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Wood, that <br />Resolution No. 82-275, denying the claim of Michael Cochran in the sum of $204,593 <br />for damages incurred when he was involved in an accident on Stanley Boulevard, and <br />referring the matter to the City Attorney for further handling, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Brandes <br /> <br />Denial of Claim of Pacific Telephone <br /> Mr. MacDonald presented his report (SR 82:266) dated July 9, 1982, regarding <br />this matter. <br /> <br /> Councilmember Mercer abstained from participation on this item due to Conflict <br />of Interest. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />Resolution No. 82-276, denying the claim of Pacific Telephone in the sum of $5,000 <br />for damages to one of their toll cables, and referring the matter to the City <br />Attorney for further handling, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Brandes <br />ABSTAINED:Councilmember Mercer <br /> 7. 7/27/82 <br /> <br /> <br />
