q. Adoption of Resolution No. 83-359, finding that the vacation of a portion of <br /> Hopyard Road is consistent with the General Plan and that the superseded street <br /> is unnecessary for present or prospective public use; and finding that the sum- <br /> mary vacation procedure is applicable to the vacation of Parcels 1 and 2 because <br /> the portions of Hopyard Road to be vacated have been superseded by relocation, <br /> and to the vacation of Parcel 3 (public service easement) because the date of <br /> dedication was between one and five years preceding the proposed vacation and <br /> the easement has not been used since it was dedicated, and transferring title to <br /> Prudential Insurance Company. <br /> <br />r. Adoption of Resolution No. 83-360, finding that a portion of Old Hopyard Road <br /> (Shell site) vacation is consistent with the General Plan and that the superseded <br /> street is unnecessary for present or prospective public use; finding that the <br /> summary vacation procedure is applicable because the portion of Old Hopyard Road <br /> to be vacated has been superseded by relocation; finding that access shall not be <br /> cut off to any person's property which, prior to relocation, adjoined the street <br /> being vacated; finding that no public service easements shall be terminated as a <br /> result of the proposed vacation; direct the City Manager not to record the reso- <br /> lution of vacation until the following conditions have been satisfied: (a) that <br /> all utilities located within the portion of Old Hopyard Road to be vacated shall <br /> be re!ocated in accordance with the Johnson (Owens) Drive-Hopyard Road intersection <br /> improvement plans; and (b) that all easements necessary for the relocated utilities <br /> be secured. <br /> <br /> s.Adoption of Resolution No. 83-361, approving claims for the month of July, 1983, <br /> in the amount of $2,83S,8S8.01. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Mercer on item 4a <br /> <br />MATTERS INITIATED BY COUNCILMEMBERS <br /> Councilmember Brandes requested that a letter be written to Zone 7 regarding the <br />erosion problems on the arroyo behind Del Prado from Hopyard to 1-680. He stated the <br />situation is so bad that there is danger to swimming pools and roads in this area, <br />and he felt something should be done before the rainy season begins. Council concurred. <br /> <br /> Councilmember Brandes stated he had received complaints about construction in the <br />Del Prado area relative to dust caused by heavy grading, and also equipment working <br />late. He requested staff to investigate the matter. <br /> <br /> Councilmember Brandes asked if there are any alternatives relative to the "No <br />Parking" signs every fifteen feet on Hopyard Road and Valley Avenue, which he felt <br />detracted from the landscaping. Staff advised this matter would be referred to Staff <br />Traffic Committee for their review and recommendation. <br /> <br /> Councilmember Mercer stated there was an article in the latest Western Cities <br />magazine advising that PG&E will conduct surveys on ways for cities to conserve on <br />energy, and also how to borrow money. He requested this matter be investigated to <br />see if it would be advantageous for the city to participate.
