217: <br /> <br /> The Poll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mercer, Mohp, Wood, and Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Report on Mitigation Measures Agreements with North Pleasanton Developers <br /> Mr. MacDonald presented his report (SR 83:353) dated August 18, 1983, regarding <br /> this matter. <br /> <br /> Councilmember Mercer asked if the developers had been notified of this item. <br /> Mr. MacDonald stated they had not been notified. Mayor Butler stated he felt this <br /> staff report is a good mechanism to determine if there is an issue, and that it <br /> needs further study and possible public hearings. Councilmember Brandes stated he <br /> did not feel there has been enough notification. He suggested the matter be continued <br /> and that a subcommittee be appointed to work out a viable plan. He stated he would <br /> volunteer to serve on the subcommittee if it is formed. <br /> <br /> Councilmember Mercer stated that developers in the North Pleasanton area will be <br />paying special assessments in the approximate amount of $90,000-$100,000 per acre, <br />that there will be an excess of $9 million, and he did not feel that additional <br />taxes or fees should be assessed. <br /> <br /> Councilmember Brandes stated he feels it is important to have some kind of <br />mechanism that would allow the City to require developers to be responsible for <br />any unforeseen costs related to their development at a later time, rather than <br />having these expenses borne by the taxpayer. He stated this City Council and <br />future City Councils should have some options if revenue projections do not come <br />through as now projected, and if there are some large costs to the City that cannot <br />be determined at this time. <br /> <br /> Councilmember Mohr stated the projected $9 million excess is money generated <br />by all property ow-~ers; homeowners as well as developers. She stated she is pre- <br />pared to support staff recommendations. <br /> <br /> Mayor Butler stated there is no way to know at this time about surpluses or <br />deficits, and the City may need a mechanism to take care of short falls. He stated <br />he felt there needs to be further input from staff regarding refinement of the re- <br />commendations but did not think that a committee should be formed at this time. <br />Mayor Butler stated he had concern that the City might not be able to cover all <br />costs at a later date related to development. <br /> <br /> Mr. Walker suggested staff put together some sort of mechanism to raise money <br />in case the fiscal impact study is not correct in its projections. <br /> <br /> Mr. Joe Callahan, representing Callahan Pentz, stated that as a developer he <br />would prefer to know up front what development taxes or fees would be required <br />rather than being assessed later on, if it is determined that additional fees will <br />be necessary. He stated that while he is not in favor of additional fees he could <br />see the merit of such a mechanism to protect the City against large costly unfore- <br />seen necessary projects such as soundwalls or street extensions due to development <br />impacts. <br /> <br /> After further discussion, Mayor Butler requested the City Manager to prepare a <br />report with further recommendations regarding methods of cost recovery generated by <br />new commercial/industrial development. <br /> <br /> lOo 8/23/83 <br /> <br /> <br />
