117 <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 83:269) dated July 14, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing open on the application and the negative <br />declaration. <br /> <br /> Mr. Gordon Fisk, 279 Castlecrest, Walnut Creek, architect for the project, stated <br />he concurred with the staff report and conditions contained therein. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing closed <br />on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />Resolution No. 83-313, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate for <br />PUD (Planned Unit Development) design review approval and conditional use permit <br />approval for an approximately 12,000 sq. ft. electrical supply warehouse/office and <br />related facilities on an approximately .87 acre site at 2166 Rheem Drive, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmembers Brandes and Mercer <br /> <br /> It was moved by Councilmember Mohr, and seconded by Mayor Butler, that Resolution <br />No. 83-314, approving the application of BCSM Partners for PUD (Planned Unit Develop- <br />ment) design review approval and conditional use permit approval for an approximately <br />12,000 sq. ft. electrical supply warehouse/office and related facilities on an approxi- <br />mately .87 acre site at 2166 Rheem Drive, subject to the conditions contained in staff <br />report 83:269 dated July 14, 1983, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Mohr-, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: Councilmembers Brandes and Mercer <br /> <br /> Councilmember Mercer re-entered the meeting at 11:35 P.M. <br /> <br />Vacation of a Portion of Johnson Drive <br /> Mr. MacDonald presented the report of the Assistant City Attorney (SR 83:274) <br />dated July 19, 1983, regarding this matter. <br /> <br /> Mayor Butler declared the public hearing open on this item. <br /> <br /> No one in the audience spoke in favor of or in opposition to the matter. <br /> <br /> Mayor Butler declared the public hearing closed. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Mohr, that <br />Resolution No. 83-315, after finding the proposed vacation is consistent with the <br />General Plan and that the superseded street is unnecessary for present or prospective <br />public use; finding that the summary vacation procedure is applicable because the <br />portion of Johnson Drive to be vacated has been superseded by relocation; and find- <br />ing that the public convenience and necessity require the reservation and exception <br />of a public service easement over the entire roadway proposed for abandonment; ap- <br />proving vacation of a portion of Johnson Drive, be adopted. <br /> <br /> 14. 7/26/83 <br /> <br /> <br />
