143 <br /> <br />quirement that all units be rented for a period of five years does not become effec- <br />tive until June 1, 1983, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br />Application of Valley Business Associates and Sente Associates Seven for a major <br />modification to case PUD-?9-13 pertaining to building heights, size of trucks, per- <br />mitted truck routes and other possible changes to the zoning ~nd development plan <br />for Valley Business Park, an approximately 70 acre industrial park now under con- <br />struction on the south side of Valley Avenue immediately east of the residences on <br />the east side of Kolln Street. The property is zoned PUD (Planned Unit Develop- <br />~ent)-Industrial District <br /> Mr. Harris presented his report (SR 83:142) dated April 18, 1983, regarding this <br />matter. <br /> <br /> Mayor Butler declared the public hearing. open on the application and the mitigated <br />negative declaration. <br /> <br /> Mr. David Martin, partner Valley Business Associates, reviewed the history of the <br />property. He stated there are three issues he would like to discuss: modification of <br />truck restriction; modification of Valley Business Park's participation in certain <br />assessment districts; and building heights on the west side of the property. Mr. <br />Martin advised he has had some complications with tenants because of the restriction <br />of size of trucks, adding that this is the only business park in the City of Pleasan- <br />ton with this restriction. He stated that traffic engineers as well as consultants <br />in acoustics have been hired to complete studies on the situation, which show that <br />truck traffic will not adversely affect the area. He stated he is willing to install <br />a soundwall and that he is also proposing to install landscaping consistent with that <br />of the business park and to be maintained by the business park. He advised that he <br />had received correspondence from eight residents in the area indicating they would <br />prefer a seven foot high as opposed to nine foot high soundwall along the south side <br />of Valley Avenue between Santa Rita Road and Valley Business Park. He stated the <br />height of the wall should be decided by Council. <br /> <br /> Mr. Martin stated that the extension of Valley Avenue required Valley Business <br />Park to participate in an assessment district for the acquisition of E1 Charro Road. <br />He advised that a great deal of time and money has been spent in an attempt to acquire <br />E1 Charro but to no avail. He requested that Valley Business Park be allowed to ex- <br />change participation in an assessment district for the acquisition of E1 Charro Road <br />for their participation on the Valley Avenue extension. <br /> <br /> Mr. Martin reviewed the building height consideration of 17 feet high, stating <br />that the property has be regraded to lower the base 1-1~ feet. He stated that for <br />further mitigation measures he has offered to install a sound wall or screening wall <br />along the western property line. He advised there are 42 homes on the east side of <br />Kolln Street adjacent to the park, of which 17 homes have existing fences. He re- <br />viewed three alternatives for a soundwall or screen wall as follows: (1) installation <br />of a 6 foot high soundwall along the entire length of the western property line of <br />Valley Business Park; (2) installation of a 10 foot high free-standing wall (which is <br />economically not feasible); and (3) installation of an 8 foot high soundwall 27 feet <br />off the property line. He stated he had concerns regarding the policing of the area. <br />He advised that he had met with the affected homeowners in an attempt to mitigate <br />the concerns of these residents. <br /> <br /> Councilmember Brandes asked if there are any plans for opening up Kolln Street <br />onto Valley Avenue.
