Zonin~ for the <br /> property is PUD (Planned Unit Development)-Low Density Residential and Open Space <br /> District <br /> <br /> Consider adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 83:87) dated March 1, 1983, regarding this <br />matter. He also presented proposed changes to three conditions as submitted by Mr. <br />Dunkley, representing Mutual Land Company, as follows: (1) change Condition No. 2 to <br />read "That the developer shall dedicate to the City for emergency access and utility <br />purposes a 10' wide section of land necessary to connect the cul de sac shown as Grey <br />Eagle Court to the southeast corner of the subject property"; (2) change Condition No. <br />5 to include "Building pad areas will be resubmitted with the tentative map to re- <br />flect changes in the street layout and reduced grading in the project"; and (3) <br />Condition No. 32 shall include "Uses of the property may include a limited number <br />of animals as specified and controlled by the CC&Rs which will be approved by the <br /> ma" <br />planning division at the time of the final p . <br /> <br /> Mr. Harris advised that staff concurs with the changes to Condition No. 5 and <br />Condition No. 32, but do not agree with the change to Condition No. 2. He stated it <br />cannot be determined at this time the exact circulation pattern and he felt staff <br />should be allowed to maintain a fair amount of discretion as to the best alternative <br />for tie-in between the existing development in Vintage Hills and the Kottinger Ranch <br />area, especially since it is not known at this time how Kottinger Ranch is going to <br />be developed. He stated that if it is determined in the future that the easement is <br />not needed for street purposes then the land could be vacated. He added that a <br />through circulation system provision is needed. Mr. Harris stated that staff concurs <br />with the Planning Commission recommendations. <br /> <br /> Mayor Butler declared the public hearing open on the application and the miti- <br />gated negative declaration. <br /> <br /> Mr. Art Dunkley, representing Castlewood Properties, developer of the Grey Eagle <br />Estates for Mutual Land Company, presented a plan showing the proposed development. <br />He stated it will be a private-gated project on 1/2 to 5 acre size lots with the <br />average lot size being 1.7 acres, and that there will be minimum grading and intru- <br />sion into the open space. He stated he concurs with the Planning Commission recom- <br />mendations with the exception of those explained earlier by Mr. Harris. He stated <br />that every effort has been made to develop a unique, tasteful and beautiful project. <br />He advised the private-gated entrance is needed to insure privacy, reduce littering, <br /> <br /> 5. 3/8/83 <br /> <br /> <br />
