191 <br /> <br /> MaFor Mercer declared the public heaping open on the application and the nega- <br /> tive declaration. <br /> <br /> Mr. Dana Owyoung, 255 Ygnacio Valley Road, Walnut Creek, representing Jerry Loving <br /> -- Architects, stated the project meets the requirements of City codes and he feels the <br /> project design is attractive and appropriate for the site. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br /> closed on the application and the negative declaration. <br /> <br /> Mayor Mercer stated he had asked to have this matter appealed because of his con- <br /> cern relative to density. He advised that he has carefully reviewed the proposed plans <br /> for this project and is satisfied that it is appropriate and meets City requirements. <br /> He expressed appreciation to Messrs. Joy and Loving for reviewing the plans with him, <br /> and apologized for any delay he may have caused. <br /> <br />T~ It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />~!~ Resolution No. 84-441, determining on the basis of a review of initial environmental <br />C~ study done for this project, that no significant environmental impact would occur as <br />~[ outlined in the City's guidelines and that a negative declaration is appropriate in <br /> connection with the application of Patrick Joy and Jerry Loving for design review <br /> approval for a fourteen unit residential condominium complex on an approximately .5 <br /> acre site located at the southwest corner of the intersection of Peters Avenue and <br /> Rose Avenue, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ' ABSENT: Councilmembers Brandes and Butler <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br /> Resolution No. 84-442, denying the appeal by the City Council of a decision of the <br /> Design Review Board, and approving Z-84-185, the application of Patrick Joy and <br /> Jerry Loving for design review approval for a fourteen unit residential condominium <br /> complex on an approximately .5 acre site located at the southwest corner of the <br /> intersection of Peters Avenue and Rose Avenue, subject to the following conditions: <br /> (1) that the development be substantially as shown on the site plan, elevations, <br /> landscape plan, floor plans, and grading plan, Exhibit A, on file with the Planning <br /> Department; (2) that all fences facing Peters Avenue and Rose Avenue shall be tex- <br /> tured stucco matching the stucco proposed for the main buildings on the site; (3) <br /> that the fence around the patio for unit 11 shall be a maximum of 30 inches in height; <br /> (4) that the columns supporting the carports shall be wooden beams or shall be veneered <br /> with wood; (5) that the railings surrounding the decks facing Peters Avenue shall be <br /> wood lattice or shall appear to be wood lattice; (6) that the two screening fences be- <br /> tween the parking area and Rose Avenue shall be a maximum of 30 inches in height; (7) <br /> that the sidewalk on Rose Avenue be constructed at property line unless otherwise <br /> approved by the City Engineer; (8) that the electroller on Peters Avenue be relocated <br /> by the developer if required by the City Engineer; and (9) that this project shall be <br /> subject to all Standard Conditions of Development, made part of this case by reference~ <br /> except conditions 21, 25, 29, 31, 33, 34, 35, 36, 46, 49 and 50, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmembers Brandes and Butler <br /> <br /> 5. 8/28/84 <br /> <br /> <br />
