standard requirements as well as specifically requiring the following: (1) the exten- <br />sion of utility systems necessary to serve the DeGarmo property shall be constructed <br />to the satisfaction of the City Engineer, and all costs and fees shall be paid by the <br />DeGarmo's; (2) the existing septic tank and seepage pits shall be filled to the satis- <br />faction of the City Engineer; and (3) the existing well shall be disconnected from the <br />house water lines and used for irrigation and swimming pool filling only, and the new <br />City water connection shall be in full compliance with City requirements for backflow <br />prevention, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Approval of Pleasanton/Dublin Transit Study <br /> Mr. Walker presented the report of the Assistant to the City Manager (SR 84:217) <br />dated April 18, 1984, regarding this matter. <br /> <br /> Councilmember Mohr advised that the Cities of Dublin and Livermore had approved <br />the study at their Council meetings held last night. <br /> <br /> It was moved by Councilmember Mohr, and seconded by Councilmember Wood, that <br />Resolution No. 84-207, approving in principle the Pleasanton/Dublin Transit Study; <br />directing the City Councilis representative on the Transit Study's Policy Committee <br />and the appropriate City staff to work with the representatives of the other partici- <br />pating jurisdictions to put the joint powers agreement and bylaws in final form and <br />prepare an implementation plan and schedule; and directing the staff to submit the <br />joint powers agreement, the bylaws and the implementation plan to the City Council <br />for approval on or about July 1, 1984, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Discussion of Proposed Transportation Systems Management Ordinance <br /> Mr. Swift presented his report (SR 84:224) dated April 19, 1984, regarding this <br />matter. <br /> <br /> Mr. Jack Hovingh, 4250 Muirwood Drive, stated the TSM ordinance is a good stab <br />at solving problems. He suggested the following changes: (1) under No. 1 Section C- <br />Findings, that the comment "exceeding the City noise ordinance or State or Federal <br />air standards", be added after in-parenthesis LOS E; (2) item 3G i~ definition - that <br />peak hours of 7:30 a.m.-8:30 a.m. and 4:30 p.m.-5:30 p.m., should be less specific on <br />hours; (3) under item 4-C-2B - any reasonable combination of TSM measure including but <br />not limited to transit related programs ride sharing other than vehicle commute modes, <br />should be change to other than non-vehicle commute modes; and that over time should be <br />changed to over a period of time; and (4) add a Section 12 - in the event that 45% re- <br />duction of peak traffic does not achieve the minimum standards of traffic level service <br />or causes a noise level that exceed City standards or air standards set or exceed <br />State or Federal standards the City reserves the right to require a greater reduction <br />in peak traffic than 45% to achieve these minimum standards. <br /> <br /> Mr. Jack Swanson, representing Prudential Insurance Company and Ca!lahan Pentz <br />stated that overall he felt the TSM ordinance is an excellent ordinance but that after <br />a start up period of two years on a voluntary basis then the ordinance should be put <br />on a mandatory basis. <br /> <br /> After discussion, Mayor Mercer directed staff to prepare a draft Transportation <br />Systems Management ordinance to be considered in approximately six weeks. <br /> <br /> 11. 4/24/84 <br /> <br /> <br />
