It was moved by Councilmember Mohr, and seconded by Councilmember Wood, that <br />Ordinance No. 1119, to be read by title only and waiving further reading thereof, <br />ordering a referendum election to be held on April 10, 1984, to submit resolution <br />No. 83-501 to the voters of the City of Pleasanton; the proposed wording on the <br />ballot should read "Shall Resolution No. 83-501 of the City Council (which provides <br />that the Pleasanton General Plan permits Hacienda Business Park (PUD-8!-30) and the <br />commercial/office industrial projects already approved as of May 1983) be affirmed?"; <br />directing that arguments for and against Resolution No. 83-501 are to be submitted to <br />the City Clerk by January 31, 1984; rebuttal arguments are to be submitted to the City <br />Clerk by February 14, 1984; Mayor Butler and Vice Mayor ~ercer are directed to prepare <br />ballot arguments and rebuttals for consideration of signature by each Councilmember; <br />the City Attorney is directed to prepare a synopsis of Resolution No. 83-501 pursuant <br />to Elections Code Section 4018; the City Attorney is directed to prepare an impartial <br />analysis of Resolution No. 83-501 pursuant to Elections Code Section 5011, this anal- <br />ysis shall be available to both opponents and proponents by January 24, 1984; the <br />County Registrar of Voters is to be notified that the election is to be held on the <br />above-specified date; the City Manager is authorized to contract with the Alameda <br />County Registrar of Voters for performance of the necessary election activities; <br />and the City budget is hereby amended to provide $17,000.00 for costs associated <br />with conduct of this special election, be introduced and adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Mercer requested that the general plan be amended at the next <br />general plan hearing date, to remove the line indicating that there will be a road <br />on West Las Positas Boulevard to Livermore. After discussion, it was moved by <br />Councilmember Mercer, and seconded by Councilmember Brandes, that Council initiate <br />an amendment to the Circulation Element of the Pleasanton General Plan to look at <br />the possibility of removing West Las Positas Boulevard east of the City limits from <br />the plan, and tentatively scheduling this matter to be heard by the Council at their <br />meeting of March 27, 1984. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Mercer requested that the Mayor write a letter to the Pleasanton <br />Meadows Homeowners Association to inform this group that the above action has been <br />taken by Council. <br /> <br /> Councilmember Brandes advised there is again a problem with Viacom Cablevision <br />and leakage of the Playboy channel to non-subscribers of this X-rated channel. He <br />stated he felt there is some technical incompetency that should be corrected. He <br />reviewed the previous problems and actions that had been taken by Viacom in an attempt <br />to correct the matter. After discussion, it was moved by Councilmember Brandes, and <br />seconded by Councilmember Wood, that Resolution No. 84-16, that the City Council re- <br />affirms its position that receipt of the Playboy channel by non-subscribing households <br />is a violation of the City's Franchise Ordinance which requires that the system shall <br />be installed and maintained in accordance with the "highest and best accepted stan- <br />dards of the industry", and that if Viacom cannot correct the problem by March 1, <br />1984, or submit an acceptable plan for correcting the problem or demonstrate that the <br />problem does not exist, then Viatom may be declared to be in willful violation of the <br />Franchise Ordinance and may be subject to franchise revocation, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSEHT: None <br /> 5. 1/9/84 <br /> <br /> <br />
