The roll call vote was as follows: AYES: Councilmembers Butler and Wood NOES: Councilmembers Brandes, Mohr, and Mayor Mercer ABSENT: None After further discussion, it was moved by Councilmember Mohr, and seconded by Councilmember Brandes, that Ordinance No. 1204, to be read by title only and waiving further reading thereof, amending Chapter 13 of Title II, Section 2-20.04 P.M.C. listing exemptions to the Growth Management Plan is amended by adding a subsection (i) to read as follows: "(i) Projects of 50 units or less subject to the City Council finding that the project meets the criteria set forth in Section l(a)(iv) of Exhibit A to Resolution No. 82-66, as amended, establishing Growth Management Procedures and Guidelines", be introduced, and that Resolution No. 85-307, amending Resolution No. 82-66 to add Section l(a)(iv) to Exhibit A as follows: "(iv) Fifty (50 Unit Exemption (P.M.C. Section 20.04 (i)). Projects which meet the following criteria shall be exempt projects within the meaning of Section 20.04(i): A. There are fifty (50) on less units in the project; B. Maximum of one exemption per calendar year for entire City; C. The City Council finds that conditions of approval of the project ade- quately address the public needs and cumulative effects created by the project. In making this determination, the City Council shall consider cumulative effects of the proposed project taken together with past and anticipated future projects, including particularly anticipated projects in the vicinity by the same developer; D. The project developers shall purchase a commitment for 25% of its units from the current mortgage revenue bond program sponsored by the City; be adopted. Mayor Mercer stated he had requested this item be con- sidered because of an incident that happened to a citizen recently. After discussion, it was moved by Mayor Mercer, and seconded by Council- member Mohr, that Ordinance No. 1205, to be read by title only and waiving further reading threreof, providing that dogs with a propensity to bite other animals are vicious dogs, and related amendments, be introduced.
