197 <br /> <br />1. That a second floor may be added to any of the original one-story homes (the <br /> Bernal Model, Plan 2) in the Old Towne development as long as the outside <br /> dimensions of these homes are not changed in any way; <br /> <br /> 2. That the revised fencing for the Old Towne open space area shall be as shown <br /> on the site plan, Exhibit A, dated 1/9/85 on file with the Planning Department; <br /> <br />3. That approval of this case is subject to all 15 conditions contained in the <br /> letter from Cork Harbour dated 11/27/84, made a part of this case bv reference, <br /> except that the following shall be added to condition number 14: <br /> <br /> "In order to ensure that all fencing is installed at the same time, a <br /> contract between the property owners and a contractor of their choice <br /> shall be presented to the City showing that the contractor is obligated <br /> and has the right to construct all fencing as shown on site plan, Exhibit <br /> A, dated 1/9/85. This contract shall indicate when the fencing shall be <br /> installed and shall be submitted to the City before case PUD-79-11-4M <br /> becomes effective. The design of the proposed fencing shall be approved <br /> by the Planning Department prior to installation"; <br /> <br /> 4. That all fencing shall be installed no later than 10/1/85; <br /> <br />5. That except as modified herein, all conditions of cases PUD-79-11, PUD-79-11-1M, <br /> PUD-79-!l-2M and PUD-79-il-3M shall remain in full force and effect, <br /> <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />PUD-84-19,. Application of Richard Guasco et al to rezone the approximately one acre <br />site located at 3932 Old Santa Rita Road from the C-S (Commercial Service) District <br />to the PUD (Planned Unit Development)-Commercial Services District or to any other <br />zoning district consistent with the General Plan <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Harris presented his report (SR 85:46) dated January 22, 1985, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the negative <br />declaration. <br /> <br /> Mr. Martin Inderbitzen, representing the applicant, concurred with the staff <br />report. He stated this will allow for completion of a traffic circulation for <br />development of the North Pleasanton area and also allow Mr. Guasco to continue <br />his wrecking yard business with the City having more control over the business. <br /> <br /> No one in the audience spoke in opposition to the item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, that <br />Resolution No. 85-54, determining on the basis of a review of initial environmental <br />study done for th~s project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate in <br />connection with PUD-84-19, application of Richard Guasco et al to fezone the approxi- <br /> <br /> 7. 1/22/85 <br /> <br /> <br />
