Mr. Terry Remitz, 15 Twelveoaks Drive, asked for delay of the project un- <br /> til some of the items are clarified; there are a lot of open ends. He felt <br /> Council should be specific in regard to the park access. He expressed concern <br />F"- regarding traffic impact on Foothill Road, and bicycle paths. <br />F"' Mr. Ted Fairfield rebutted by stating that the Foundation has evidenced <br />L(') it's good faith to provide park access as shown on the original preliminary <br />~ map. He stated they are agreeable to an access at either end of the develop- <br />CD ment but would be opposed to one in the middle. He advised that many studies <br />~ have been done regarding the geological stability of the land which reveal <br /> that it is safe to build on. Mr. Fairfield emphasized that the plans present- <br /> ed tonight are very preliminary and that specific plans will be presented <br /> later regarding grading, drainage, landscaping, etc. He stated there will be <br /> public hearings at the Planning Commission and City Council to consider the <br /> final development plan. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hear- <br /> ing closed on the general plan amendment, the Planned Unit Development ap- <br /> plication, and the Environmental Impact Report. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mer- <br /> cer, that Resolution No. 85-585, certifying that the Environmental Impact Re- <br /> port in connection with GP-85-8 and PUD-85-15, Walter Johnson Foundation, has <br /> been completed in compliance with CEQA and reviewed and approved by Council, <br /> be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br /> NOES: None <br /> ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by <br /> Councilmember Mohr, that Resolution No. 85-588, after making the staff recom- <br /> mended findings with modifications, approve GP-85-8, application of the Walter <br /> Johnson Foundation to amend the Land Use Element designation of the General <br /> Plan to redesignate an approximately 173.2 acre site west of Foothill Road and <br /> below the 670' elevation from Public Health and Safety to Low Density Residen- <br /> tial, and not changing the approximately 35.8 acre site east of Foothill Road <br /> from Low Density Residential, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br /> NOES: None <br /> ABSENT: None <br /> <br /> After further discussion, it was moved by Councilmember Mercer, and secon- <br /> ded by Councilmember Wood, that Ordinance No. 1236, to be read by title only <br /> and waiving further reading thereof, approving modified conceptual development <br /> plan for PUD-85-15, application of the Walter Johnson Foundation for PUD <br /> (Planned Unit Development) zoning and development plan approval for a 210 unit <br /> project consisting of 95 custom lots and 115 townhouses on a 316 acre site <br /> located on both sides of Foothill Road midway between Bernal Avenue and <br /> Castlewood Drive, including (a) a public access road in an alignment to be <br /> determined at the time of approval of a final development plan to reach the <br /> originally proposed staging area, said access road not to be constructed until <br /> a Bernal Park master plan has been prepared which satisfactorily addresses <br /> concerns over its compatible use with the project, including fire hazard, van- <br /> dalism, loitering, parking, and traffic, and not allowing East Bay Regional <br /> <br /> 12-17-8S <br /> - 7 <br /> <br /> <br />
