He <br />added the downtown needs all the retails business it can get. <br /> <br /> Mr. Howard Sword, currently serving on the Board of Directors for the <br />Downtown Association, stated it is this group's strong feeling to support the <br />overlay district. He suggested a retail use on the ground floor of the sub~ <br />ject building. <br /> <br /> Mr. Corley stated that everyone is in concurrence that the Church occupy <br />the second floor and allow retail on the first floor. He suggested approving <br />the Conditional Use Permit on the second story only. He stated the Church has <br />two major events per year that might adversely impact the surrounding busi- <br />nesses, but he felt there would not be any parking problems the remainder of <br />the time. <br /> <br /> Councilmember Mohr expressed concern that the Church attendance would be <br />growing, and wanted assurance that if they outgrew the building they would be <br />willing to relocate. She also wanted assurance that the Church would comply <br />with the City regulations and conditions of the permit. Mr. Corley stated the <br />Church will cooperate with the City. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hear- <br />ing closed on this item. <br /> <br /> Mayor Brandes stated he had requested this item be appealed because of his <br />concerns as to the Conditional Use Permit for a church use in the Central Com- <br />mercial District. He felt with the downtown overlay and work done to develop <br />the downtown it is not a logical location for a church; retail would be more <br />appropriate at this location. <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by <br />Councilmember Mercer, that Resolution No. 85-559, denying AP-85-20, appeal of <br />the City Council of a decision of the Planning Commission, and approving UP- <br />85-29, application of the Church of Divine Man for a conditional use permit to <br />operate a religious institution at 328 St. Mary's Street, as conditioned by <br />the Planning Commission, with all church uses restricted to areas of the <br />building not formerly leased to Cellar Liquors (i.e. second floor and kitchen <br />on first floor) with the remainder of the first floor restrict to retail use, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, and Mohr <br />NOES: Councilmember Wood and Mayor Brandes <br />ABSENT: None <br /> <br />North Pleasanton Improvement District (NPID) Freeway Portion <br /> Mr. Okamura presented his report (SR 85:560) dated November 19, 1985, <br />regarding this matter. <br /> <br /> Mayor Brandes declared the public hearing open on this item. <br /> <br /> Mr. Peder Jacobson, 6122 Allbrook Circle, stated he lives adjacent to the <br />North Pleasanton Improvement District, and that increased traffic and noise <br />directly impacts his property. He stated that the Hacienda off-ramps and <br />interchange should be the first one approved to alleviate traffic to the <br /> <br /> 10 - 11-19-85 <br /> <br /> <br />
