MATTERS CONTINUED FOR DECISION <br />Adoption of Ordinance No. 1221, Approval of PUD-77-10, Applica- <br />tion of Ken Gooch and Associates for a major modification to <br />amend the grading plan for PUD-77-10, Pleasant Hills, to allow <br />regrading of five lots <br /> (Intro. 10-1-85, 4-Ayes, 1-Absent) <br /> Mayor Mercer stated that Ordinance No. 1221 was introduced on <br />October 1, 1985, by a vote of 4-Ayes, 1-Absent, and that it was <br />now in order to adopt the ordinance. <br /> <br /> Ms. Carol DiSalvi, 4961 Dolores Drive, stated that one of the <br />trees approved for removal in connection with this application is <br />a vocal point for the Mission Hills Knoll area and is a histori- <br />cal landmark. She stated that the Pleasanton Hills Homeowners <br />obtained the services of another tree consultant. She presented <br />a report from Nelda Matheny, Horticultural Consultant, which <br />states that the tree can be saved with proper treatments and on- <br />going maintenance. <br /> <br /> Mayor Mercer asked who would pay for the tree maintenance. <br />Ms. DiSalvi stated this can be worked out by the developer and <br />the person who buys the lot. <br /> <br /> Mr. John Vanderoovart, representing Ken Gooch, stated he has <br />read the report. He commented on the statement that the report <br />advises this tree is "marginally" suitable for preservation be- <br />cause of its relatively poor health. He stated he is willing to <br />spend money to save the tree, however, he is still concerned <br />about legal liability due to the hazardous condition of the tree. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and <br />seconded by Councilmember Butler, that Ordinance No. 1221, ap- <br />proval of PUD-77-10, application of Ken Gooch and Associates for <br />a major modification to amend the grading plan for PUD-77-10, <br />Pleasanton Hills, to allow regrading of five lots, and based upon <br />the developer's representation, that the main focal tree be saved <br />and treated as set forth in the tree consultant's report, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />Adoption of Ordinance No. 1222, Facilitating the Recodification <br />of the Ordinance Code of the City of Pleasanton through the <br />Repeal and Amendment of Various Obsolete Sections of Said Code <br />(Intro. 10-1-85, 4-Ayes, 1-Absent) <br /> Mayor Mercer stated that Ordinance No. 1222 was introduced <br />October 1, 1985, by a vote of 4-Ayes, 1-Absent, and that it was <br />now in order to adopt the ordinance. <br /> <br /> It was moved by Councilmember Butler, and seconded by Coun- <br />cilmember Brandes, that Ordinance No. 1222, facilitating the <br />recodification of the Ordinance Code of the City of Pleasanton <br />through the repeal and amendment of various obsolete sections of <br />said code, be adopted. <br /> <br /> - 17 - 10-15-85 <br /> <br /> <br />
