PUD-84-4-3M, Application for a Major Modification to an Approved
~_evelopment Plan to Establish a Listing of Permitted and Conditionally
ermitted Uses for a Shoploing Center Complex on an Approximately 7.7 acre
_~ite, Located at the S'6~heast Corner of the Intersection of Santa Rita
~Road and West Las Positas Boulevard, Zoning for the property is PUD
'~Planned Unit Development) - Commercial Offices District

Mr. William G. Kovac, 3124 Weymouth Court, stated that it has come to-
is attention that the original project will be amended with a major
modification for more uses. He stated that the only objection he has to
the uses that are added is that the project was changed to Commercial and
Offices while he was under the impression tha~ it was
Neighborhood-Commercial which was the least amount of problems between the
neighbors and commercial development. Mr. Kovac stated that he has no
problem with the list of permitted uses except that he feels they will be
high traffic generators. He stated there will be a parking problem between
the project and spill over from the shopping center that should be
5ddressed. He feels all the uses should be conditional to a point where it
can be brought back for review. He stated that he felt the project was
changed to Commercial and Offices because the tenants will be high traffic
generators. Mr. Kovac stated he would like to have the list be all
conditional uses.

Brian Swift stated that the project was designed with neighborhood
commercial parking requirements in which there should be abundant parking.

Mr. John Ferreri, 865 Abbie Street, stated that this is not a new list
of uses, that it is the list that was approved originally on the property
when he acquired it. There were items on the list that he had agreed with
the homeowners not to have (i.e., convenience markets, liquor stores,
arcades, bars, or any all-night type uses). Mr. Ferreri stated that staff
submitted their list which omitted uses from the original list. Of those
omitted, Mr. Ferreri felt seven should be added back on, which are listed
in the staff'report. He felt there would be a time delay in having
permitted uses rather than conditional uses. ·

It was moved by Councilmember Mohr to make hardware and video
conditional uses and have the remainder uses permitted. The motion died
due to the lack of a second.

It was moved by Councilmember Brandes, and seconded by Councilmember
Mood that video should be permitted with all others as conditional.
Phe roll call vote was as follows:
AYES: Councilmembers Brandes, Wood
NOES: Councilmembers Butler, Mohr, and Mayor Mercer
ABSENT: None

9-3-85 13
