Approval of Fifth Amendment to Development Deferment Agreement with Robert <br />Frank/Sylvan Gross <br /> Mr. MacDonald presented his report (SR 86:118) dated March 21, 1986, <br />regarding this matter. He explained that the extension time will expire be- <br />fore the next Council meeting and if no extension is approved then the <br />developer would lose his sewer permits. The developer would be eligible to <br />apply for more sewer permits but would have to pay full price. <br /> <br /> Mr. Robert Antenuci, representing the new property owner, stated the prop- <br />erty was purchased sixty days ago and that the takeover has caused delays in <br />the project. He advised it will take approximately ninety days to complete <br />and get approval of the final plans, and they expect to break ground before <br />the end of June or July. He stated it seems inappropriate to jeopardize the <br />project because of circumstances over which they had no control. <br /> <br /> Councilmember Mercer stated that the additional sewer costs would be ap- <br />proximately $81,000 if the extension is not approved, and that this cost would <br />probably be passed on to the buyer; therefore he will change his vote on this <br />matter. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember But- <br />ler, that Resolution No. 86-143, approving the fifth amendment to the Develop- <br />ment Deferment Agreement with Robert Frank/Sylvan Gross, extending the date <br />during which building permits will not be issued from April 1, 1986 to July <br />10, 1986, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, and Vice Mayor Mohr <br />NOES: Councilmember Wood <br />ABSENT: Mayor Brandes <br /> <br />REPORTS OF THE CITY ATTORNEY <br /> There were no reports of the City Attorney presented at this meeting. <br /> <br />COMMUNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the City Council Calendar for the information~of the <br />Council. <br /> <br /> Councilmember Butler requested that the TWA meetings be added to the <br />Calendar. <br /> <br />EXECUTIVE SESSION <br /> The Executive Session was held at the beginning of the meeting. <br /> <br />ADJOURNMENT <br /> There being no further business at 9:50 p.m., it was moved by Councilmem- <br />ber Butler, and seconded by Councilmember Wood, that the meeting be adjourned <br />to meet again in Regular Session on April 15, 1986, 8:00 p.m., in the Pleasan- <br />ton Council Chambers. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Wood, and Vice Mayor Mohr <br />NOES: None <br />ABSENT: Mayor Brandes <br /> <br /> 4-1-86 <br /> ~ 9 <br /> <br /> <br />
