Approval of Fifth Amendment to Development Deferment Agreement with Robert Frank/Sylvan Gross Mr. MacDonald presented his report (SR 86:118) dated March 21, 1986, regarding this matter. He explained that the extension time will expire be- fore the next Council meeting and if no extension is approved then the developer would lose his sewer permits. The developer would be eligible to apply for more sewer permits but would have to pay full price. Mr. Robert Antenuci, representing the new property owner, stated the prop- erty was purchased sixty days ago and that the takeover has caused delays in the project. He advised it will take approximately ninety days to complete and get approval of the final plans, and they expect to break ground before the end of June or July. He stated it seems inappropriate to jeopardize the project because of circumstances over which they had no control. Councilmember Mercer stated that the additional sewer costs would be ap- proximately $81,000 if the extension is not approved, and that this cost would probably be passed on to the buyer; therefore he will change his vote on this matter. It was moved by Councilmember Mercer, and seconded by Councilmember But- ler, that Resolution No. 86-143, approving the fifth amendment to the Develop- ment Deferment Agreement with Robert Frank/Sylvan Gross, extending the date during which building permits will not be issued from April 1, 1986 to July 10, 1986, be adopted. The roll call vote was as follows: AYES: Councilmembers Butler, Mercer, and Vice Mayor Mohr NOES: Councilmember Wood ABSENT: Mayor Brandes REPORTS OF THE CITY ATTORNEY There were no reports of the City Attorney presented at this meeting. COMMUNICATIONS There were no Communications presented at this meeting. CITY COUNCIL CALENDAR Mr. Walker presented the City Council Calendar for the information~of the Council. Councilmember Butler requested that the TWA meetings be added to the Calendar. EXECUTIVE SESSION The Executive Session was held at the beginning of the meeting. ADJOURNMENT There being no further business at 9:50 p.m., it was moved by Councilmem- ber Butler, and seconded by Councilmember Wood, that the meeting be adjourned to meet again in Regular Session on April 15, 1986, 8:00 p.m., in the Pleasan- ton Council Chambers.
