449 <br /> Mr. Swift presented his report (SR 86:285) dated July 15, 1986, regarding <br /> this matter. <br /> <br /> Mayor Brandes declared the public hearing open on this item. <br /> <br /> No one in the audience Spoke in favor of or in opposition to the <br /> application. <br /> <br /> Mayor Brandes declared the public hearing closed. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mer- <br />cer, that Ordinance No. 1266, to be read by title only and waiving further <br />reading thereof, approving RZ-86-5, application of the City of Pleasanton for <br />an amendment to the Municipal Code pertaining to design review procedures for <br />overheight fences between 6 feet and 8 feet, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, and Mayor Brandes <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />Authorization to Initiate Condemnation Action for Southern Pacific Railroad <br />Right-of-Wa at Bernal Avenue <br /> Mr. Macdonald presented his report (SR 86:293) dated July 8, 1986, regard- <br />ing this matter. <br /> <br /> Mayor Brandes declared the public hearing open on this item. <br /> <br /> No one in the audience spoke in favor of or in opposition to the item. <br /> <br /> Mayor Brandes declared the public hearing closed. <br /> <br /> Councilmember Mohr stated that the City has been diligently working to <br />consolidate the railroad tracks, and she would resist any plans for double <br />tracks through town for any rail system. <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember But- <br />ler, that Resolution No. 86-337, approving a Resolution of Necessity to ac- <br />quire by Eminent Domain Proceedings property needed for improvement of Bernal <br />Avenue - Southern Pacific right-of-way (Main Street) consisting of approxi- <br />mately 19,340 sq. ft., be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, and Mayor Brandes <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />MATTERS CONTINUED FOR DECISION <br />Adoption of Ordinance No. 1262, Regulating Smoking in Public and Work Places <br />(Intro. 7-1-86, 3-Ayes, 1-No, 1-Absent) <br /> Mayor Brandes stated that Ordinance No. 1262 was introduced on July 1, <br />1986, by a vote of 3-Ayes, 1-No, 1-Absent, and that it was now in order to <br />adopt the ordinance. <br /> <br /> Ms. Diane Cowart, 5578 Sonoma Drive, stated she has breathing problems and <br />that this ordinance is necessary for her survival. She stated there is also a <br />problem with chemicals in new buildings that she and others are allergic to. <br />She urged adoption of the ordinance prohibiting smoking in public and work <br /> <br /> - 7 - 7-15-86 <br /> <br /> <br />
