He requested that Council elimi- <br />nate Condition No. 3 of the staff report. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hear- <br />ing closed on the appeal and negative declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, <br />that Resolution No. 86-481, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br />impact would occur as outlined in the City's guidelines and that a negative <br />declaration is appropriate in connection with AP-86-10, Appeal of a decision <br />of the Planning Commission denying the application of Grey Eagle for a major <br />modification to an approved development plan to allow for the relocation of <br />the designated building pad for Parcel 14 within the 28-unit residential <br />development located on the south side of the eastern terminus of Crellin Road, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, <br />that Ordinance No. 1278, to be read by title only and waiving further reading <br />thereof, approving AP-86-10, appeal of a decision of the Planning Commission <br />denial, and approving the application of Grey Eagle for a major modification <br />to an approved development plan to allow for the relocation of the designated <br />building pad for Parcel 14 within the 28-unit residential development located <br />on the south side of the eastern terminus of Crellin Road, subject to condi- <br />tions set forth in Staff Report 86:437, but eliminating Condition No. 3 and <br />replacing it with the requirement of a maintenance agreement and letter of <br />credit in a form approved by the City Attorney to insure that early grading of <br />this driveway would not result in damage to the surrounding area, be <br />introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br />WA-86-2, Application of Lawrence and Victor Lund, Jr., for cancellation of <br />Williamson Act Land Conservation Agreement (A?ricultural Preserve 1974-15) for <br />an approximately 53 acre site, located genera ly in the area east of the ter- <br />minus of Juniper Street and San Jose Drive <br /> Mr. Swift presented his report (SR 86:418) dated October 7, 1986, regard- <br />ing this matter. <br /> <br /> Mayor Brandes declared the public hearing open on this item. <br /> <br /> 14 - 10-7-86 <br /> <br /> <br />
