Zoning for the property is PUD (Planned Unit <br />Development)-Low Density Residential District <br /> <br />Consider Adoption of Negative Declaration <br /> Mr. Swift presented his report (SR 86:437) dated October 7, 1986, regard- <br />ing this matter. <br /> <br /> Mayor Brandes declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Tom Plummer, 29 California Street, representing the appellant, stated <br />they agree with the staff report with the exception of Condition No. 3, which <br />requires that the driveway shall be constructed only after a building permit <br />has been issued for the parcel. He stated the prospective buyer of the parcel <br />can assure that they will proceed to build. <br /> <br /> Mr. Michael O'Callaghan, 4558 Second Street, stated he ha~ met with the <br />prospective buyers and feel they have come to an amiable solution for the <br />development of this property, which will be an attribute to the subdivision. <br />He asked Council to give approval not only to the relocation of the pad but <br />stipulate that they have approval of the grading plan and house location, and <br />that the approval would remain the same for whoever buys and builds on the <br />property. He stated he is in agreement with the remainder of the report. He <br />requested assurance from the Council that the hill would be put back to its <br />former order should mud slides occur; he felt some type of protection agree- <br />ment should be required with the site plan and grading plan. He stated his <br />only concern is if the Black's do not build; he wanted assurance that the <br />house will be built as now expected. <br /> <br /> Mr. Jim Colburn, builder on #18, Grey Eagle, stated he is concerned about <br />the extend of the original grading plan. He stated he can support the plan <br />that is being considered tonight. <br /> <br /> Councilmember Butler stated the only issue is the grading and the oppor- <br />tunity to allow some construction to get started before the winter season. He <br />suggested the posting of a maintenance bond to assure that the appropriate <br />grading and erosion control will take place. <br /> <br /> 13 - 10-7-86 <br /> <br /> <br />
