Ms. Barbara Ward, resident of Stoneridge Townhouse Association, stated <br />that noise from Hots Restaurant for the last eight months has been in- <br />tolerable; affecting the sleep of at least eleven families in this area. She <br />advised that Hots is no longer a restaurant; it went into a night club about a <br />year ago. <br /> <br /> After discussion, Mayor Mercer instructed staff to prepare a report and <br />draft amendment to the noise ordinance, for consideration by Council at the <br />meeting of September 1, 1987. <br /> <br />PUBLIC HEARINGS <br />AP-87-14, Appeal of a decision of the Plannin~ Commission denying the applica- <br />tion of Thomas Black for a major modification to an approved development plan <br />for a residential subdivision to modify the permitted building envelope for an <br />existing parcel, located at 4 Red Feather Court. Zoning for the property is <br />PUD (Planned Unit Development)-Low Density Residential <br />(Contd. Open from 7-21-87 and 8-4-87} <br /> Mr. Swift presented his report (SR 87:311) dated July 21, 1987, regarding <br />this matter. <br /> <br /> Mayor Mercer declared the continued public hearing Open on this item. <br /> <br /> Mr. Keith Fraser, Attorney, 2109 4th Street, Livermore, representing the <br />appellant, stated they have tried to work with the homeowners to resolve their <br />concerns; there are 28 lots in this subdivision and there are only 5 or 6 ob- <br />jectors to the proposed change of pad location. He stated the objection is <br />because of obstruction of view. He presented letters from the following resi- <br />dents in Grey Eagel in support of the proposed change: Sue Ann Staley, Pat <br />Johnson, Ken R. Miller, David and Eileen Silva, Paul B. Molkenbuhr, and Rick <br />Bentley. He presented pictures showing three different views from homes to- <br />ward the proposed building site. He stated the Black's are trying to cooper- <br />ate with the neighbors by compromise; the objectors are a long way from the <br />Black residence and he does not see any problem. <br /> <br /> Mr. Jay Frechette, 1369 Spring Court, Sunnyvale, Architect, presented a <br />scaled model of the hillside area and homes in Grey Eagle subdivision. He <br />stated the Fire Marshal wants the Black home moved back 5 feet to allow easier <br />turn-around for emergency vehicles. He stated that the slope of the driveway <br />would be approximately 18-19%. He reviewed the grading that would be neces- <br />sary with the relocation of the pad. <br /> <br /> Mr. Ken Miller, #3 Eaglet Court, stated he lives across from this lot; he <br /> felt the Black's should be able to build their home and he was not opposed to <br /> the location. <br /> <br /> Mr. Tom Plummer, 5 Red Feather Court, whose lot is across the street, sup- <br /> ported the plan as proposed. He stated he would like to see the grading of <br /> the slope minimized as much as possible. <br /> <br /> The following persons spoke in opposition to the change in location of the <br /> building pad: <br /> <br /> Mr. Michael O'Callaghan, 8 Grey Eagle Court, stated he was among the first <br /> property owners to buy a lot in this subdivision. He designed his house and <br /> built in accordance with the PUD. He presented maps showing the original PUD <br /> approval in comparison with the proposed modification.
