Councilmember Mohr stated that a court house is traditionally in the down- <br />town area, however, she felt this use fits comfortably within the Office set- <br />ting, and because the parking and security issues have been adequately ad- <br />dressed she will support the proposed court house in Hacienda Business Park. <br /> <br /> Councilmember Wilson stated the convenience of having a court house in <br />Pleasanton is a great advantage. He wanted it made clear that no prisoners <br />would be held overnight in the jail cells. Judge Ronald Hyde assured,him that <br />there would be no overnight stay of prisoners. <br /> <br /> Mayor Mercer asked if the facilities would be made available for other <br />public functions at night. Judge Hyde stated that there are plans to hold <br />night court several nights a week, however, if the facility is not being used <br />by court activities, it would be available for other public functions. Mayor <br />Mercer stated that there were no problems when the Court House was located in <br />Pleasanton on Angela Street several years ago, and he did not anticipate any <br />problems with it being located in the Hacienda Business Park. <br /> <br /> Councilmember Brandes stated that Hacienda Business has been very careful- <br />ly planned; Council has taken extra precautions regarding this unique park. <br />He stated that many uses had been talked about for the park but a court house <br />was never contemplated, and he did not feel it would have been included. He <br />felt a court house in Hacienda Business Park is inappropriate and out of <br />place. He felt because of economic reasons, an empty building has been of- <br />fered for lease by the developer for use as a court house. He felt a court <br />house should be constructed on existing public property. Councilmember Bran- <br />des commended Judge Hyde for his efforts in trying to solve an unacceptable <br />situation in Livermore, which should be resolved by the County. He stated it <br />is his strong opinion that a court house in Hacienda Business Park is inap- <br />propriate; that it is a major modification to the use of the park and should <br />go through the normal public hearing process; and that Councilmembers are in- <br />correct in not allowing this matter to be considered through normal channels. <br />He asked that the record show if there is ever a problem that he was not in <br />support of the court house in Hacienda Business Park. <br /> <br /> Mr. Bill Godfrey, Alameda County Police Officer, reprsenting Sheriff Plum- <br />mer and Judge Hyde, assured Council there will not be any prisoners held over- <br />night in the facilities; this Court will be abiding by the restrictions es- <br />tablished by the State Board of Corrections. <br /> <br /> It was moved by Councilmember Wilson, and seconded by Councilmember Mohr, <br />directing Staff to approve the Minor Modification to Z-83-192, Callahan, Swee- <br />ney, and O'Brien (Z-87-299), as presented in Information Report 87:71, subject <br />to a condition that no prisoners are to be kept overnight. <br />The roll call vote was as follows: <br />AYES: Councilmember$ Mohr, Wilson, and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: Councilmember Butler <br /> <br /> It was moved by Councilmember Wilson, and seconded by Councilmember Mohr, <br />that Council take no action regarding the proposed Municipal Courthouse in <br />Hacienda Business Park, in which case staff will treat the use as an "office", <br />thus permitting the use and allowing the minor modifications; and directing <br />staff that any facility where any prisoners are kept overnight is not an of- <br />fice and would constitute a violation of the PUD and Development Agreement. <br />The roll call vote was as follows: <br /> <br />219 <br /> <br />6 - 7-7-87 <br /> <br /> <br />
