Mr. Swift presented his report (SR 87:287} dated July 7, 1987, regarding <br />this matter. <br /> <br /> Councilmember Wilson abstained from participating in this item due to Con- <br />flict of Interest. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the <br />negative declaration. <br /> <br /> Mr. Michael Goldsworthy, 78 Mission Drive, representing Peregrine Develop- <br />ment Company, stated he concurs with the staff report. He added that many <br />more trees will be added than have been removed. He stated he felt the re- <br />quirement of paying money for the undergrounding of utilities at a later date <br />would place a burden on the developer; he asked that some other arrangement be <br />made regarding this condition. <br /> <br />No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br /> Council discussion ensued regarding how best to handle the payment by the <br />developer for undergrounding of utilities. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, <br />that Resolution No. 87-295, determining on the basis of a review of initial <br />environmental study done for this project, that no significant environmental <br />impact would occur as outlined in the City's guidelines and that a negative <br />declaration is appropriate in connection with PUD-87-9, application of Pere- <br />grine Development Company for Planned Unit Development rezoning and develop- <br />ment plan approval for construction of a 12 unit apartment complex, to be lo- <br />cated on an approximately 2.8 acre site located at 1045 Division Street, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmcmber Butler <br />ABSTAINED:Councilmember Wilson <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mohr, <br />that Ordinance No. 1323, to be read by title only and waiving further reading <br />thereof, and finding that the rezoning and development plan are consistent <br />with the General Plan and the purposes of the PUD Ordinance, approve PUD-87-9, <br />application of Peregrine Development Company for Planned Unit Development <br />rezoning and development plan approval for construction of a 12 unit apartment <br />complex, to be located on an approximately 2.8 acre site located at 1045 Divi- <br />sion Street, subject to conditions contained in Staff Report 87:287, and that <br />the payment for undergrounding of utilities be worked out to the satisfaction <br />of City staff and the developer, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Mayor Mercer <br />NOES; None <br />ABSENT: Councilmember Butler <br />ABS?AINED:Councilmember Wilson <br /> <br />235 <br /> <br />- 14 7-7-87 <br /> <br /> <br />
