337 <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, Wilson, and Mayor Mercer <br />NOES: Councilmember Butler <br />ABSENT: None <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no reports of Boards and Commissions presented at this meeting. <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Consideration of Alternative Courses of Action Regarding Hots Noise Complaint <br /> Mr. MacDonald presented his report (SR 87:395) dated September 1, 1987, <br />regarding this matter. <br /> <br /> Ms. Barbara Ward, representing the Stoneridge Townhouse Owners Associa- <br />tion, stated they have reviewed the report and feel the recommendations will <br />not solve the noise problems. She stated that control of the trash dumping <br />and special patrol in the parking lot will alleviate those problems, but the <br />main concern of the surrounding neighbors is the inability to sleep at night <br />because of the noise problems. She cited an incident that happened in the <br />neighborhood Saturday night when a man knocked on a homeowners door, then <br />rushed inside saying another man was after him with a gun; this type of situa- <br />tion is intolerable to homeowners near Hots. <br /> <br /> Mr. Bob Humbert, 7533 Rosedale Avenue, Vice President of the Stoneridge <br />Townhouse Owners Association, stated that residents of the 243 homes in this <br />area are concerned about the Hots problem. They were told when Hots was occu- <br />pied that it would be a nice restaurant; now it has turned into a nightclub. <br />Residents are adversely impacted by the noise and fear for their safety. <br /> <br /> Mr. John Shadow, Springdale Avenue, stated he investigated his neighbor- <br />hood before purchasing his home; at that time Hots was a respectable res- <br />taurant. Now it is impossible to sleep, especially weekends, because of the <br />loud noise coming from this establishment, which should be considered as a <br />nightclub. <br /> <br /> Mr. Bill Laube, 855 Main Street, owners of the Pleasanton Hotel, requested <br />that Council not consider any restrictions that would impact other establish- <br />ments such as his, who abide by the codes. <br /> <br /> Council discussion ensued regarding the best method to control the Hots <br />problem. <br /> <br /> Mr. Bill Eastman, Police Chief, requested that residents in the neighbor- <br />hood call the Police Department with any complaints so that it might be on the <br />record. He stated he would meet with the owner of Hots in an attempt to get <br />them to abate the noise problem. <br /> <br /> Mayor Mercer instructed staff to prepare a report regarding further alter- <br />natives to control the Hots problem, such as nuisance ordinance, noise or- <br />dinance, or conditional use permit, for consideration at the Council meeting <br />of September 15, 1987. <br /> <br />REPORTS OF THE CITY MANAGER <br />Minutes from Staff Traffic Committee Meeting of Auqust 11, 1987 <br /> Mr. Elliott presented his report (IR 87:82) dated September 1, 1987, <br />regarding this matter. <br /> <br /> - 12 9-I-87 <br /> <br /> <br />
