AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer NOES: None ABSENT: None Agreement with Frank Auf der Maur et al for construction of and partial reim- bursement for Bernal Avenue between Stanley Boulevard and Del Valle Parkway (Continued from earlier in the meetinq) Mr. Corley, Attorney representing Frank Auf der Maur, stated he has dis- cussed the issue brought up by Mr. Inderbitzen and is agreeable to having a$20,000 cap on fees from the front of Kottinger Ranch with a $259.00 fee per unit on the back of the Kottinger Ranch with a cap of $20,000. It was moved by Councilmember Brandes, and seconded by Councilmember Wil- son, that Resolution No. 88-84, approval of agreement with Frank Auf der Maur et al for construction of and partial reimbursement for Bernal Avenue between Stanley Boulevard and Del Valle Parkway, and adding a section 3{b}{4} provid- ing for costs of making the water line greater than 12 inches in diameter split equally between the City and developer, and adding a limitation of $20,000 on the front of Kottinger Ranch with $259.00 per unit on the back, not to exceed a total of $20,000 on the back of Kottinger Ranch, be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Wilson, and Chairperson Mohr NOES: None ABSENT: None ABSTAINED:Councilmember Butler and Mayor Mercer ADJOURNMENT There being no further business at 10:25 p.m., it was moved by Councilmem- ber Wilson, and seconded by Councilmember Brandes, that the meeting be adjour- ned to meet again in Regular Session on March 1, 1988, 8:00 p.m., in the Pleasanton Council Chambers.
