He <br />also stated that not enough notice was given by the City to the affected resi- <br />dents regarding this item on the agenda. <br /> <br /> Mr. Mike Faber, 833 Abbie, stated he is concerned about the road extension <br />and development of the Bonde property. He stated he does not want to stop the <br />road but is concerned about future development. The agreement states that the <br />City will support and incorporate into the construction plans for Bernal <br />Avenue extension and E. Angela Street any street widenings or other modifica- <br />tions deisred by Bonde, or successor, to facilitate future development of the <br />subject property; that indicates to him that development is imminent. He felt <br />not enough notice was given the the surrounding property owners regarding this <br />matter. He opposed the findings of the negative declaration regarding no <br />serious public controversy, growth inducing impact, noise, and traffic <br />volumes. <br /> <br /> Mr. Swift advised that this property is under the Williamson Act and can- <br />not be developed until such time as there is non-renewal which takes ten <br />years, or through cancellation, which would require Council action. Also no <br />development would take place without growth management program approval. He <br />stated that Shapell Industries has presented a preliminary plot plan, but it <br />will take 6 to 8 months to petition for cancellation of the Williamson Act. <br /> <br /> Mr. Faber questioned the financing of the project. Mr. Swift advised that <br />Kottinger Ranch will pay the up-front money for construction of the road; <br />through a long-term agreement they have agreed to pay for one/half of the <br />road. If and when Shapell develops they will be required to pay $375,000 pro <br />rata share for the road. The City will pay the remaining amount. <br /> <br /> Mr. Faber asked if a portion of the property is changed because the road <br />goes through will that portion automatically be taken out of the Williamson <br />Act and be developable. Mr. Swift advised that it would be; the next step is <br />a request for annexation by Mrs. Bonde. <br /> <br /> Mr. Faber reiterated his concern regarding the wording of the contract. <br /> <br /> Mr. Lou Helgeson, 872 Abbie, stated he agrees that there needs to be a <br />road but would like to see it down in the Valley because of noise. He felt <br />the agreement was loose in areas and everything should be settled before the <br />agreement is approved to prevent any controversy later on. <br /> <br /> Ms. Patsy Depiero, 831 East Angela, stated she is unhappy about the road. <br />She advised that the schools are overcrowded now, there are sewer problems, <br />and the intersections are at gridlock. She felt the developers are pushing <br />for this matter, and it isn't what the people of the community want or need. <br /> <br /> Mrs. Margaret Tracy, representing Preserve Area Ridgelands Committee, en- <br />couraged the continued use of "Agricultural" zoning so as not to abuse the <br />Williamson Act. <br /> <br /> Mr. Don Feyrer, 683 Windmill Lane, strongly urged Council to be specific <br />in the terms of the agreement. He did not want a soundwall to be built with <br />delays such as the one on Hopyard Road.
