Mr. Ken Brokow, 1712 Martin Avenue, stated that not all the houses will <br />be tilted so that is not a valid reason to stay within 10 feet. As a taxpayer <br />he has a CT...,.L~u. ZrLit'y in~ in ~aeping tb~ area beautiful. He stated he is <br />concerned about the type of f~, over a period of time all f~ <br />deteriorate. The crux of the matter is, as hc~eowners they have agreed to a <br />plan of 25 foot setback that is being kick~_~__ hack to 10 feet, it cuts into the <br />landscaping in that area which they are not required to do under normal <br />circuS. He feels they should be able to have the 10 foot setback and <br /> <br /> Mr. Herb Singleton, 2207 Martin Avenue, resident for 11 years, stated <br />there has been change and ccmprumise in the neighborhood in recent years. One <br />of the things that ba-~ prc~ this is' that the neighbors were told in <br />writing that these were to be custam homes, and it has ended up as a tract. <br />They thought there would be L and U shaped hcmBs on corner lots; to allow the <br />hc~es to be on an angle which the ~ says, is how the 25 foot setback <br />originated. This was done to give some latitude in landscaping and be able to <br />hide the fence. He took exceptions to Lot 7 because the fence is quite long <br />down Nicole Avenue. Tba owner of the property took title on February 29, <br />1988, so he would have to take exception to Mr. Stern's cuu.,~ent that regarding <br />fence setbacks. He personally did confront Mr. Brokow prior to his pouring <br />the concrete on the posts showing him a copy of the modification, so he was <br />aware that he was putting the fence in i~properly. About three times the <br />people were in favor of 25 foot setbacks versus the number of people who <br />signed the petition wanting to move it back. The people who wanted the 10 <br />foot setback were only the affected people, none of the neighbors wanted it. <br />He stated that the fences on Cameron that are set back 25 feet or over look <br />great. That illustrates what most of the residents in the area want. He <br />stated that if bas Homes misrepresented themselves to some of the people then <br />some compensation to those homeowners might be in order. He stated for the <br />oa~Dn good of the neighborhood the 25 foot setback should be retained. He <br />stated that rail or cyclone fences would be ideal. He would also support 30" <br />high fences. <br /> <br /> There being no further testimony, Mayor Marcer declared the public <br />hearing closed on this item. <br /> <br /> After discussion, it was moved by Counci~ Wilson, and seconded by <br />Oounci~ Brandes, that Resolution No. 88-352, denying FjD-83-12-5M, <br />application of bas Homes for a major modification to an approved development <br />plan for an existing residential project to allow 6 foot fences to be <br />constructed within 7 feet of the property line on the street side of corner <br />lots located on Lots 7, 11, 14, 15, and 19 of Tract 5445 on Martin Avenue, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: CounciLmembers Brandes, Butler, and Wilson <br />NOES: Cauncilmember Mohr and Mayor Mercer <br />ABSENT: None <br /> <br />item 9h <br />AP-88-15, Appeal by the City Council of a decision of the Planning C~,.,,~sion <br />approvinq Case UP-88-21, the a~plication of Paul Creamer for a conditional <br />use ~ermit to ope/-ate a take-out food es~bl ~-~hment, vi~eo arcade, and t~ <br /> - 14 - <br /> <br /> 7-19-88 <br /> <br /> <br />
