355 <br /> <br />railroads but there is additional noise associated with these types of busi- <br />ness. As a contractor he has tried to minimize noise. He stated the Echo <br />PB4500 blower is designed for cities for its quietness and it creates no more <br />noise than ordinary traffic. He advised he has an obligation to keep the <br />shopping center clean and for Council to limit the hours from 10 p.m. to 6 <br />a.m. would create a hardship since the Safeway Store is open 24 hours a day. <br />He stated he tried to contact Mr. Berkheiser to explain his operation. He <br />advised he conducted a survey on Cortez Court, going door to door himself; <br />three residents were not at home, one was a City worker who declined to com- <br />ment, one was a neighbor of Mr. Berkheiser who did not want to comment, the <br />remainder stated they were not bothered with the blower noise. Mr. Zerodny <br />stated he could live with the requirement of using the Echo PB4500 blower. <br /> <br /> Mr. Bill Hirst, 478 Ewing, asked how staff took the noise measurements at <br />the shopping center. Mr. MacDonald advised the measurements were most always <br />taken 75 feet at the back, not the front of the shopping center. <br /> <br /> Mr. John Innes, 1586 Foothill Road, stated he felt it discriminatory and <br />unfair to require the use of an Echo PB4500 blower, there are other manufac- <br />tures who make blowers that are just as quiet. Mr. MacDonald advised that the <br />blower can be by any manufacturer as long as it meets the performance <br />standards. <br /> <br /> Mr. Thurman Caudill, Augustine Street, stated his neighbor uses a blower <br />and blows the leaves onto other yards; he asked that the ordinance include a <br />clause to prohibit this action. <br /> <br /> Council discussion ensued regarding broadening the categories and enforce- <br />ment of the ordinance. Chief Eastman stated that the broader categories would <br />be enforceable but he felt it would be better to have a more inclusive <br />ordinance. <br /> <br /> Mayor Mercer stated he did not feel people should have to put up with ex- <br />cessive noise during the night, even if the shopping center cleaners had to do <br />their job by hand. <br /> <br /> It was moved by Mayor Mercer, and seconded by Councilmember Brandes, that <br />Ordinance No. 1356, to be read by title only and waiving further reading <br />thereof, amending the noise ordinance to regulating leaf blowers as follows: <br />"The operation of any noise-creating blower, power fan or internal combustion <br />engine (including leaf blowers), the operation of which causes noise due to <br />the explosion of operating gases or fluids is prohibited, unless the noise <br />from such blower or fan is muffled and such engine is equipped with a muffler <br />device to deaden such noise in such a manner so as not to be plainly audible <br />at a distance of either seventy-five feet from the source of the noise, or <br />between the hours of 10:00 p.m. and 7:00 a.m.", be reintroduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />item 12b <br />Review of Target Allocations for Growth Management Proqram for 1989 <br /> Mr. Swift presented his report (SR 88:231) dated May 17, 1988, regarding <br />this matter. <br /> <br /> - lO 5-17-88 <br /> <br /> <br />
