415

REPORTS OF BOARDS AND COMMISSIONS
item lla
Council meets as Building Inspection Appeals Board
Mayor Mercer convened the meeting of the City Council to the
Building Inspection Appeals Board.

Appeal of the Uniform Building requirement for sloped glazing and
skylights (Chapter 34), Shea Homes
Mr. Smith presented his report (SR 88:586) dated December 20,
1988, regarding this matter.

Mr. Mark Dartez, Western Aluminum, representing Shea Homes,
stated the architect failed to show adequate details on the plans
and that 45 homes were built before the City brought it to his
attention that the skylights and sloped glazing do not meet the
requirements of Chapter 34 of the Uniform Building Code. He
stated that all houses built since this matter was brought to his
attention do meet the requirement. He asked for a waiver on the
homes previously constructed. He added that corrective measures
are not satisfactory and would only create more problems.

Mr. Smith stated that lamination does create problems and
that the homeowners are opposed to any lamination of the
skylights.

Council discussion ensued regarding the problems with
lamination, and emphasized that while the Council normally
requires that the Code be enforced, in this instance there is
sufficient reason to waive the requirement on the homes previously
constructed.

It was moved by Member Brandes, and seconded by Member Mohr,
granting the appeal by Shea Homes, waiving the Uniform Building
Code requirement (Chapter 34) for sloped glazing and skylights
on those homes in which the glazing has already been installed.
The roll call vote was as follows:
AYES: Members Brandes, Butler, Mohr, Tarver, and Chairperson
Mercer
NOES: None
ABSENT: None

Chairperson Mercer adjourned the meeting of the Building
-Inspection Appeals Board, and reconvened the meeting of the City
Council.

REPORTS OF THE CITY MANAGER
item 12a
Request for Annexation of Approximately 2.07 Acres located on the
South Side of Sycamore Road West of Amber Lane fPioneer
Investment)
Mayor Mercer declared this item removed from the agenda, at
the request of the applicant.

- 20 - 12-20-88
