393 <br /> <br /> Mr. Stanley Rathbone, 325 Ray Street, asked why a middle <br />school is being placed adjacent to the senior citizen housing <br />complex. Mayor Mercer stated he felt the two project would be <br />compatible and could exist adjacent to each other without <br />conflict. <br /> <br /> Mr. Rathbone stated the signal lights at Main and Ray Streets <br />should be timed to allow for a longer left-turn period from Main <br />onto Ray Street. Mayor Mercer directed staff to investigate this <br />matter. <br /> <br /> Mr. Rathbone stated there needs to be load limit signs on Ray <br />Street for the large trucks that travel on that street. Mayor <br />Mercer directed staff to investigate this matter. <br /> <br /> Mr. Oscar Hernandez, Kottinger Avenue, stated there is still <br />a problem with McCarthy Landscaping, who has been operating a <br />business out of a house near him without a license and violating <br />other City codes. He advised that the shed has been removed and <br />some of the trucks, but the owner still uses a large truck at the <br />home. He presented a letter sent by the City to the Landscape <br />Company advising that it has until December 20th to comply with <br />the code. He stated he received a letter from the Planning <br />Department stating that McCarthy Landscape Company had another <br />site and would be moving its operation. He asked if the City <br />could fine the Company for not being licensed for three years <br />while operating in the City and being in violation to the code. <br />The City Attorney advised that since McCarthy Landscape Company <br />has been given a time limit in which to comply, he did not feel <br />further action would be advisable at this time. <br /> <br /> Mayor Mercer stated that with regard to items 9a, 9b, and <br />9c, Earl Augusta and Stanley Partners application, because the <br />majority of this property is owned by Amador Valley Savings and <br />Loan and there are three members of the Council who own stock, <br />these three members must draw straws to determine which one of the <br />Councilmembers will be acting on this item. He stated there also <br />needs to be a draw on the Community Development Agency items. He <br />asked the City Attorney to explain the decision of the Fair <br />Political Practices Commission that was received this date. <br /> <br /> Mr. Roush stated that an opinion had been requested from the <br />FPPC as to whether or not there were any conflicts of interest <br />with respect to the Councilmembers or Agency members concerning <br />adoption of the redevelopment plan, because the redevelopment plan <br />does involve property downtown and three of the members of Council <br />do have investments in savings and loans or banks which have <br />property downtown. He advised he received information from the <br />FPPC today that there is a potential conflict of interest with <br />respect to the Mayor and Councilmembers Butler and Mohr, because <br />of their investments in the banks. He stated that he did not <br />think the analysis that FPPC has made regarding what constitutes <br />gross revenues or what constitutes assets or liabilities with <br />respect to deposits into those institutions, is consistent with <br /> <br /> - 9 - <br /> <br /> 12-6-88 <br /> <br /> <br />
