3O5 <br /> <br />be remiss not to endorse this bond measure, adding that the beauty <br />of the open space should be preserved. <br /> <br /> Mr. Stanley Rathbone, 325 Ray Street, felt East Bay Regional <br />Park District is getting too big and should be reduced in size and <br />power. <br /> <br /> Councilmember Mohr stated she has given a great deal of <br />thought to this matter; she has a problem supporting a measure <br />which asks for more taxes and she also feels there should be more <br />park development. She stated the real choice will be made by the <br />voters no matter what Council does. She stated she will support <br />the recommendation for endorsement. <br /> <br /> Councilmember Butler stated whether or not Council supports <br />parks is not the issue; the important thing is to determine <br />whether the Park District is maintaining the land properly and its <br />use by people, and not whether the City should be recommending how <br />to vote on this issue. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Wilson, that Resolution No. 88-519, endorsing <br />Measure AA - Regional Open Space, Wildlife, Shoreline and Park <br />Bond, on the November 8 ballot, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Wilson <br />NOES: Councilmember Butler and Mayor Mercer <br />ABSENT: None <br /> <br />item 6b <br />Report to Council Re: SB 547, Buildinq Earthquake Safety Statute <br /> Mr. Roush presented his report (IR 88:79) dated November 1, <br />1988, regarding this matter. <br /> <br /> Councilmember Wilson stated he asked that this matter be <br />placed on the agenda because he feels it is important and should <br />be considered before the meeting of the Community Development <br />Agency on December 6th. He stated he is concerned about the large <br />number of buildings this Bill effects and the number of lawsuits <br />this Bill will create. It was passed in 1986 but is just now <br />coming to light. He is concerned that to bring building to code <br />will hurt the property owners. He asked if the Redevelopment Plan <br />could be altered so that low interest rate funds could be made <br />available to people who have these buildings which are not <br />reinforced. He stated that some can be removed and some cannot. <br />He asked if the Redevelopment Plan should include provision for <br />this legislation; and should a property owner make improvements <br />when in fact the City knows in two years those leasehold <br />improvements will be destroyed when structural work is required to <br />bring the buildings to code to meet this legislation. <br /> <br /> Mr. Roush stated that the Redevelopment Plan could be amended <br />at a later date to provide loans for required improvements because <br />of this legislation.
