289 <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that Resolution No. 88-522, supporting the <br />construction of two City owned gymnasiums, one on the Harvest <br />Middle School Campus and one on the new Pleasanton Middle School <br />Campus, if it is determined (a) that adequate parking is <br />available, (b) that limitations to City use of the City owned gyms <br />are reasonable as determined by staff, (c) that the City <br />gymnasiums and support facilities constructed are built in the <br />most cost effective manner while providing for adequate <br />programming, and instructing the City Manager to bring back a <br />funding mechansim to finance the projects, be adopted. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br />REPORTS OF THE CITY ATTORNEY <br />item 13a <br />Request to Approve Extension of Sewer Permits for Reynolds and <br />Brown <br /> Mr. Roush presented his report (SR 88:516) dated November 1, <br />1988, regarding this matter. <br /> <br /> Mr. Justin Roach, representing Reynolds and Brown, stated he <br />has reviewed the staff report and is in agreement with the <br />recommendations and analysis of the issue. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Wilson, that Resolution No. 88-523, approving the <br />extension of sewer permits for Reynolds and Brown and providing <br />that the permit fee paid by Delta Properties for 20,000 gallons <br />per day of sewer treatment capacity for Delta Properties (Reynolds <br />and Brown) shall be forfeited unless building permits are not <br />obtained by January 31, 1992, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br />COMMUNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the City Council Calendar for the <br />information of the Council. <br /> <br />CLOSED SESSION <br /> Mayor Mercer recessed the meeting to a Closed Session at 9:20 <br />p.m., to discuss the case of Lopez v.
