263 <br /> <br /> No one in the audience spoke in favor of or in opposition to <br />the item. <br /> <br /> Mayor Mercer declared the public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that Resolution No. 88-501, determining on <br />the basis of a review of initial environmental study done for this <br />project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration <br />is appropriate in connection with RZ-88-8, application of the City <br />of Pleasanton to prezone an approximately 27 acre site to the "P" <br />(Public and Institutional) District located at the southwest <br />corner of the intersection of Bernal Avenue and Case Avenue, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: Councilmember Mohr <br /> <br /> It was moved by Councilmember Wilson, and seconded by <br />Councilmember Butler, that Ordinance No. 1388, to be read by title <br />only and waiving further reading thereof, approving RZ-88-8, <br />application of the City of Pleasanton to prezone an approximately <br />27 acre site to the "P" (Public and Institutional) District <br />located at the southwest corner of the intersection of Bernal <br />Avenue and Case Avenue, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: Councilmember Mohr <br /> <br />item 9c <br />AP-88-21, Appeal of a decision of the Board of Adjustment denying <br />Case V-88-19, the application of Raymond Bohn for a variance from <br />the Municipal Code to allow retention of an accessory structure <br />that encroaches into the required sideyard setback of the property <br />located at 6824 Corte de Flores. Zoning for the property is PUD <br />(Planned Unit Development)-Medium Density Residential District <br /> Mr. Swift presented his report (SR 88:497) dated October 18, <br />1988, regarding this matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Raymond Bohn, appellant, stated that in 1985 he built a <br />swimming pool in his small back yard, which left him only ten feet <br />on one side and three feet on the other side. He needed a utility <br />shed to keep his tools. He advised that he kept his neighbors <br />informed about the structure and no one was opposed to it. He <br />stated he is asking for a variance because that is the only <br />location in his yard he can place the shed; it is six feet to his <br />neighbor and there are no windows on either side.
