201 <br /> <br /> Mr. Smith presented his report (SR 88:479) dated October 4, <br />1988, regarding this matter. <br /> <br /> Dr. Walter Panganiban stated that because of his location he <br />feels his pool will not be a hazard. He stated he is willing to <br />install a 3-1/2 foot fence around the pool and keep the pool <br />covered when not in use. He cited the reason for not wanting a <br />regulation height fence is because it will adversely impact his <br />view along the driveway. He felt because of the topography the <br />appropriate findings could be made to allow a variance to the <br />fencing requirements. <br /> <br /> Member Brandes asked if there would be any liability to the <br />City to allow this variance. Mr. Roush advised there would be <br />little or no liability to the City, but Mr. Panganiban would be <br />responsible for any liability because of the variance. <br /> <br /> After discussion, it was moved by Member Brandes, and <br />seconded by Chairperson Mercer, to grant an exception to the <br />fencing requirements of swimming pools, as required by Section <br />20.40.230 of the Pleasanton Municipal Code, by allowing two <br />sections of the fence facing the driveway and the entrance to be <br />3-1/2 feet high, requiring the other two sections of the fence to <br />be the required 4-1/2 feet high, and requiring that the pool be <br />covered except when in use, all with respect to a swimming pool <br />being construction at 11115 Dublin Canyon Road and owned by Walter <br />Panganiban. <br />The roll call vote was as follows: <br />AYES: Members Brandes, Mohr, Wilson, and Chairperson Mercer <br />NOES: Member Butler <br />ABSENT: None <br /> <br /> Chairperson Mercer adjourned the meeting of the Building <br />Inspection Appeals Board and reconvened the City Council meeting. <br /> <br />REPORTS OF THE CITY MANAGER (Contd.) <br />item 12a <br />Repeal of Ordinance Nos. 554 and 953 (Chapter 6.12 PMC) Providing <br />for the Requlation of Cardrooms <br /> This item was considered after Public Hearings on the <br />agenda. <br /> <br />item 12b <br />Sign Program for Library <br /> Mr. Swift presented his report (SR 88:463) dated October 4, <br />1988, regarding this matter. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Wilson, that Resolution No. 88-482, approving the <br />application of the City of Pleasanton for design review approval <br />to construct a freestanding, monument identification signage for <br />the library facility, as set forth in Staff Report 88:463, <br />excluding the reference to Alameda County Library on the sign, be <br />adopted. <br /> - 19 - <br /> <br /> 10-4-88 <br /> <br /> <br />
