There being no further testimony, Mayor Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Councilmember Wilson, and seconded by <br />Councilmember Brandes, that Resolution No. 88-429, accepting the <br />1.2 acre parcel from Mr. Molinaro needed for Nielsen Park, subject <br />to the following conditions: (1) if Stoneridge Specific Plan has <br />not been approved by January 1, 1989, the remaining portion of Mr. <br />Molinaro's parcel, approximately 19 acres, would be permitted to <br />be deleted from the Stoneridge Specific Plan and be allowed to <br />make an application for planned unit development approval and <br />collated growth management approval; (2) the cost of one-half of <br />the extention of Kamp Drive and a portion of Stoneridge Drive will <br />be constructed at the expense of Shea Homes with no reimbursement <br />sought from the owner of the 19 acre parcel; and (3) the <br />dedication of the parkland would satisfy all park dedication fees, <br />irrespective of number of units approved for the 19 acre parcel, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAINED:Councilmember Mohr <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that Resolution No. 88-430, approval of an <br />agreement with the Roman Catholic Bishop of Oakland for the <br />purchase of land for Nielsen Park, and acceptance of Grant Deed; <br />and authorizing execution of the agreement by the appropriate city <br />officials, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Wilson, and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br /> <br />item 9b <br />Old Santa Rita Road Assessment District No. 1988-1 <br /> Mr. Robert Brunsell, Bond Counsel, stated the purpose of this <br />public hearing is the acquisition of improvements already <br />completed. Since the filing of the engineer's report he has been <br />required to make a modification in the assessment role as follows: <br />removal of the lands owned by Prometheus and place that amount on <br />parcels owned by Prudential Insurance Company.
