the existing neighbors. He felt the Code is too flexible to <br />allow single story houses to be taller than two story houses. He <br />stated that Council owes it to the residents in the existing area <br />to protect them; the City should use its resources to get an <br />official settlement. <br /> <br /> Mrs. Beth McKnight, 824 Sylvaner Drive, stated that in all <br />the meetings with the developer, the bottom line was that that the <br />proposed houses would not be any higher than the existing houses. <br />She asked Council not to compromise this issue; this is a <br />statement of integrity. <br /> <br /> Mr. Howard Watenmaker, 812 Sylvaner, stated it is his <br />understanding that there are requests for modifications to the <br />grading, fence, etc., now before staff. Mr. Swift advised that <br />these are conditions of approval and the request is to change the <br />soundwall on Crellin and to regrade three lots; the City is <br />processing these modificaitons through the appropriate steps. <br /> <br /> Councilmember Brandes stated that he wants every change that <br />is presented to City staff to come to Council for review and that <br />all surrounding neighbors be notified of any proposed changes. <br />Councilmembers Mohr and Tarver concurred. <br /> <br /> Mrs. Rowlands, 830 Sylvaner, expressed disappointment in the <br />City Council; she feels it is caving in to the developers and the <br />concerns of the neighbors have been disregarded. She stated the <br />neighbors worked in good faith for over 1-1/2 years and now what <br />was agreed upon has been turned around. She stated she is <br />disappointed in staff for allowing a building to be started when <br />they knew of the neighbors concerns regarding house heights. She <br />also expressed disappointment that there could not be a full <br />Council to vote on this matter. She stated all she has to look <br />forward to is a 26 foot high house behind her home. <br /> <br /> Ms. Jeanie Davis, 827 Sylvaner, stated the home behind the <br />homes on Sylvaner is a disgrace; she has lost the privacy of her <br />backyard. She stated the builders stated they were willing to <br />work with the neighbors and to compromise; she felt the compromise <br />was all on the part of the neighbors. <br /> <br /> Mr. Frank Belecky, 892 Madeira Drive, stated he does not feel <br />the developer acted in good faith. There were many discussions on <br />the height of the proposed homes and the view lines; it was never <br />intended that the new homes would be 24 feet high. He feels that <br />if this situation is tried before a judge the case would be won by <br />the City. He stated that the City could buy the lots, then <br />resell. <br /> <br /> Ms. Jo Stillian, 3118 Catawba Court, stated that Council said <br />it would not approve anything that was like Phase I of Vintage <br />Hills; now she has a 23 foot high building behind her home, which <br />completely blocks her view. She felt the City should stand behind <br />the neighbors. She challenged Councilmember Mohr's right to vote <br /> <br /> - 23 - <br /> 4/04/8~S <br /> <br /> <br />
