Mr. Dave Fryman, representing the Mohr Park Homeowners <br />Association, stated he favors the continuance; it will give the <br />developer more time to work with the neighbors relative to the <br />proposed project. <br /> <br /> Council and staff discussion ensued regarding the meeting <br />dates and requirements for processing the Molinaro property PUD <br />and growth management. <br /> <br /> Mayor Mercer stated that since the delay was caused by the <br />City and the developer has shown good faith in his commitments to <br />the City, he felt the continuance should be granted. <br /> <br /> Councilmember Brandes felt the granting of this continuance <br />would set a precedent, which he did not feel is appropriate. <br /> <br /> Mr. Roush advised the because of the existence of unique <br />circumstances, including the agreement with the City for land <br />dedication, the findings could be made to allow this request. <br /> <br /> Councilmember Tarver stated this approval would require <br />changing the ordinance three weeks before the requirement date. <br /> <br /> Councilmember Butler stated the schedule this project is on <br />is at least half the City's responsibility; and Council has heard <br />from the homeowners that they would like further meetings with the <br />developer in an attempt to resolve their concerns, therefore he <br />felt the request for continuance should be approved. <br /> <br /> It was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, that Ordinance No. 1403, to be read by title <br />only and waiving further reading thereof, amending the Growth <br />Management Ordinance to allow Far West Associates only to apply <br />late this year (due to the special circumstances created by the <br />delay of the Stoneridge Specific Plan by the City, and allowing <br />Far West Associates to apply by June 1, 1989), be introduced and <br />adopted as an urgency measure. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmembers Brandes and Tarver <br />ABSENT: None <br /> <br />(Because the Ordinance was an urgency measure, a 4/5 vote for <br />approval was required; therefore the ordinance failed to pass.) <br /> <br /> Mayor Mercer recessed the meeting at 10:00 p.m. <br /> <br /> Mayor Mercer reconvened the meeting at 10:05 p.m. <br /> <br /> Mr. Roush advised that because of the time schedule in the <br />ordinance, Ordinance No. 1403 could be adopted as a non-emergency <br />ordinance. <br /> <br /> <br />
