487 <br /> <br />who have purchased lots to proceed to build their houses. <br /> <br /> Mr. Ralph Romero asked if Lot 14 was no longer an issue. <br /> Councilmember Brandes stated that Lots 14 and 5 are not covered by <br /> the one-story height limitation. Mr. Romero stated he felt the <br /> height limitation should have been stated rather than the one- <br /> story limitation only. <br /> <br /> Mr. Doug Johnson, purchaser of Lot 9, stated that when he <br />started this process his thinking was he would look at the CC&R's <br />and the approved plan for the development and make his <br />determination on whether or not to purchase the lot, conditioned <br />upon that and whether a home could be designed that would fit on <br />that property and be an attractive home and a good product. After <br />considering those issues, he found it to be a tight building site <br />but he decided to go ahead with it. When considering the pitches <br />of traditional design homes, he settled on an eight and twelve and <br />the staff report gives a height of 26 feet. He felt this is a <br />reasonable custom home for the area, compliment the area, and <br />increase property values. He would like to build it as designed. <br /> <br /> Mr. Ken Stockeridge, 1370 Windsor Way, stated he is under <br />contract for Lot 16, which is across the street. His is a two- <br />story, 3600 square foot house, which will set higher than any of <br />the houses in question. He stated he knew the other houses would <br />be one story, but did not expect there would be a problem with the <br />one-story structures. He stated these houses will raise the <br />property value of the property in Vintage Hills. <br /> <br /> Mr. Steve Jensen, owner of the lot across the street, stated <br />a few people always object to a project. This project has been <br />approved, people are starting to build houses, and there needs to <br />be a variety in the roof line. He asked if there would be a <br />height limitation on trees. He urged Council to go forward with <br />the project since it has already been approved. <br /> <br /> Mr. Watenmaker rebutted by stating the drawing was made, it <br />says typical one-story house, why was that written in? He stated <br />he felt the concern of the adjoining neighbors in Vintage Hills is <br />not being considered by the purchasers of the lots. <br /> <br /> Councilmember Brandes stated that Council has asked the City <br />Attorney what legally can or cannot be done regarding this issue. <br />He stated it is the City Attorney's opinion that this Council can, <br />if it chooses, take action to further define the height limitation <br />on the affected lots that have a one-story restriction. <br />Councilmember Brandes stated that many of the other issues <br />discussed as it relates to conditions of approval, e.g., <br />landscaping, etc., there is a time period in which those <br />conditions have to be met. According to the staff report the City <br />does have the proper assurances that those will be completed in a <br />timely fashion.
