Staff does agree that both Lots 14 <br /> and 5 are not subject to that restriction, and in fact neither lot <br /> had any plans currently pending before the Building Department so <br /> staff did not see any harm in holding it up. The one-story height <br /> issue is not pertinant to Lot 14 or Lot 5. <br /> <br /> Mr. Dave Spot, purchaser of Lot 7, stated he does have plans <br /> in plan check and they have been ready for two weeks; he had quite <br /> a bit of investment involved and would like to proceed in building <br /> his house as agreed upon. He stated his house is 20 feet high. <br /> <br /> Mr. Ben Fernandez, 4330 Fairlands Drive, member of the Board <br />of Directors for Amador Valley Savings and Loan and co-owner of <br />Lot 8, stated he does not have a plan yet, but asked about the <br />propriety of only three Councilmembers voting on this. Since the <br />lots have been sold, he does not see where there is a conflict of <br />interest. Mr. Roush explained that in fact Amador Valley Savings <br />and Loan does still own several of the lots so Amador Valley still <br />has a financial interest in the project. Amador Valley is also <br />under a Subdivision Improvement Agreement with the City, so it <br />has the financial interest there also. Mr. Fernandez felt it <br />would only be fair to allow the entire Council to participate. <br /> <br /> Mr. George Callaghan, future buyer of lots 1 through 5, <br />stated he could not live with any height restrictions on that <br />project. <br /> <br /> Mr. Emil Oxsen stated he does not own any of the lots in <br />question but does own lots that are not affected. He stated a <br />larger issue at stake is the restrictions on the architectural <br />value that Pleasanton tries to portray and that is beautiful homes <br />at different levels; certainly the City does not want a bunch of <br />14 foot houses that are going to look like Jensen tract. It would <br />not be in the best interest of Pleasanton to restrict any building <br />in Pleasanton. <br /> <br /> Mr. Bill Hirst, 478 Ewing, member of the Board of Directors <br />for Amador Valley Savings and Loan and purchaser of Lot 10, stated <br />he has plans on file with the City pending approval. He stated he <br />entered into contract to purchase the lot long before this <br />situation developed. He has spent several thousand dollars to <br />date in architectural fees, engineering fees and the like, and has <br />relied substantially on the land use regulations that were in <br />effect at the time he committed to purchase the lot. He stated he <br />was not privy to conversations that may have taken place between <br />Mr. Beratlis or Mr. Alexander but he cannot imagine how any person <br />looking at the schematic could conclude that there were <br />representations made as to the height of buildings that would be <br />placed on the lots there. First of all, there has been no height <br />dimension shown on the plan, there is a horizontal dimension asso- <br />ciated with setbacks.
