495 <br /> <br /> first structure is a one-story house is 28 feet high, which is <br /> totally unsatisfactory. <br /> <br /> Mrs. Beth McKnight, 824 Sylvaner Drive, stated the issue is <br />that the neighbors do not want 6 to 20 feet of dirt, and do not <br />want two-story size houses, behind their residences because they <br />would lose their privacy. She thought these conditions were <br />covered with the restriction to single-story homes. There is <br />still a question of height on the grading pads being higher than <br />hers. Then the house on Lot 11 was raised an additional two feet, <br />and she does not understand how that was counted in the total <br />height measurement. Now a house higher than the two-story tri- <br />level home two doors down from her was built after the developer <br />said that all houses on lots 1 through 13 would be single-story, <br />no taller than hers. Single-story houses on Sylvaner average 14 <br />feet high. Each person involved in this project knows the intent <br />of the communications and compromises which were made between Mr. <br />Beratlis and the neighborhood. The bottom line is, the neighbors <br />did not want excessive height, either by grading or by tall <br />houses, and Mr. Beratlis assured them they would have neither <br />one. Mrs. McKnight asked if the drawings shown the neighbors at <br />Mr. Alexander's office at one meeting were completely out of <br />scale as the staff report states, why did he do that? It can be <br />called a set-back analysis or any other description but she knows <br />that the line of sight from the windows was the major emphasis. <br />She feels the neighbors have been given misrepresentations. The <br />health, welfare, and privacy of the homeowners on Sylvaner Drive <br />and Catawba Court will be severely damaged if anything above a 16 <br />foot tall house is allowed to be built on lots 1 through 13. She <br />urged Council to go back to the intent of all the meetings and <br />limit these houses to no more than 16 feet in height. <br /> Mr. Karl E. Geier, Attorney, Miller Starr & Regalia of Walnut <br />Creek, representing Amador Valley Savings and Loan, asked if <br />Council had received the communication sent this date reqarding <br />this matter. Council acknowledged that they had receive~ the <br />letter and materials attached. Mr Geier stated many more people <br />are involved in this matter now than when it was first considered, <br />as individuals have purchased lots and are in the process of <br />building homes on their lots. He stated this project, at this <br />step, is not in the context that the Council is used to seeing; it <br />has been approved and the rules established. The big issue is <br />single-story houses behind the residences on Sylvaner and Catawba. <br />The Zoning Ordinance states a 30 foot high maximum for single <br />story houses as does the Uniform Building Code. The CC&R's, which <br />the City Attorney approved, states that the limitation on this <br />project is single-story. The conditions of approval imposed by <br />the City say a single-story, and there are no indications any <br />where that the City has ever published or included in a condition <br />of approval for this project that says anything but single-story. <br />There is nothing out but a 30 foot height limit out in this part <br />of town. Mr. Geier stated that the homes, designed with tall <br />sloping roofs, legally fulfill the requirement that they be one- <br />story, and that Condition No. 21 of the approved conditions, has <br />been fully and completely satisfied by the developer which imposes <br /> <br /> - 20 - 1-17-89 <br /> <br /> <br />
