497 <br /> <br /> The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Tarver, and Mayor Mercer <br />NOES: Councilmember Brandes <br />ABSENT: None <br /> <br /> item 10b <br />Report Regarding Conditions of Approval for Tract 5835, Vintage <br />Heights II <br /> (Since three members of the Council own stock in Amador <br />Valley Savings and Loan, which still has a financial interest in <br />this development, and a draw has been previously taken to see <br />which member could participate in items related to Tract 5835, <br />Councilmember Mohr will continue to participate and Councilmember <br />Butler and Mayor Mercer will abstain.) Mayor Mercer directed <br />Councilmember Brandes chair the meeting. <br /> <br /> Councilmember Mohr stated she had heard rumors that she has a <br />conflict of interest in this matter because of her personal <br />ownership of property within the development. She stated that <br />that was not true. Her conflict is a result of her stock <br />ownership and that she represented purchasers of lots within the <br />development. <br /> <br /> Mr. Swift presented his report (SR 89:36) dated January 17, <br /> 1989, regarding this matter. <br /> <br /> Mr. Howard Watenmaker, 812 Sylvaner Drive, presented a <br />rendering showing elevations, with houses shown on the map. He <br />stated staff told him this was not what he took it to be, (staff <br />said) it was not a building height schematic. He stated the <br />drawing was prepared by an architect for the developer and <br />approved by staff in January 1988, and he took it to be as <br />presented and approved. He stated that with staff's knowing the <br />concern of the residents on Sylvaner and Catawba regarding the <br />height of structures behind them, he could not understand why they <br />approved a single-story house 28 feet high. He stated his tri- <br />level house is only 22 feet high. He stated the windows of the <br />residence under construction look into his bedroom, which he does <br />not feel is right. Mr. Watenmaker stated the residents in the <br />area fought hard to have the one-story height restriction imposed <br />on structures behind their homes, and they anticipated that the <br />height of the one-story structures would be an average one-story <br />height of 17-18 feet. He asked if all the houses being built <br />would be finished at this height. He stated that he and others <br />are being adversely impacted, and it was the intent of the <br />conditions of approval that they would not be impacted. <br /> <br /> Mr. Rich Rollins, 830 Sylvaner Drive, stated that in all <br />discussions regarding grading and building heights, the residents <br />were told by Council to work with the developer. The meetings <br />were held and he thought everything had been worked out in a <br />manner suitable to all concerned. Renderings were presented which <br />showed only the rooftops visible. He stated the residents decided <br />they could live with looking at the tops of roofs, but now the <br /> <br /> - 19 - 1-17-89 <br /> <br /> <br />
