He wants to avoid using City streets to haul <br />off the dirt. <br /> <br /> Ms. Beth McKnight, 824 Sylvaner Drive, stated that while she <br />is not particularly opposed to these particular changes, she felt <br />the entire approval process for this project has been altered many <br />times; it seems that every time something is agreed on, it comes <br />back to Council for modification. She questioned the City's <br />process. She feels the conditions should have been made clear to <br />the people who purchased the lots. She stated that the regrading <br />will allow for larger homes to be built on the lots, thus further <br />obstructing the view of the homeowners on Sylvaner. She added <br />that the developers are beginning work each day at 6:00 a.m., and <br />also working early on Saturdays, which is in violation of the <br />conditions of approval. <br /> <br /> Councilmember Tarver stated he concurs that the regrading <br />will allow larger houses to be built on the pads. <br /> <br /> Councilmember Brandes stated that the City is trying to <br />enforce the conditions of approval and that citations have been <br />issued, but it is impossible to be on the site every minute. <br /> <br /> There being no further testimony, Councilmember Brandes <br />declared the public hearing closed. <br /> <br /> Councilmember Brandes stated he concurred that there have <br />been many changes made to this project, but he felt the changes <br />proposed at this time will be an asset to the development. <br /> <br /> Councilmember Tarver stated the regrading will create a <br />larger pad and could allow a larger house; therefore he cannot <br />support the regrading. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Mohr, that Resolution No. 89-223, approving the <br />plans for the regrading of building pad areas for Tract 5835, <br />Vintage Heights II, Lots 14, 15, 16, and 57, located at 2980, <br />2985, 2977 Amorso Court and 953 Finovino, respectively, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes and Mohr <br />NOES: Councilmember Tarver <br />ABSENT: None <br />ABSTAINED:Councilmember Butler and Mayor Mercer <br /> <br /> Mayor Mercer returned to the Chair at this time. <br /> <br />item 6b and 6c <br />GP-89-1, Application of the City of Pleasanton to amend the <br /> <br /> - 5 - 5-16-89 <br /> <br /> <br />
