139 <br /> <br /> It was moved by Mayor Mercer, and seconded by Councilmember <br />Butler, after finding that the development plan is consistent with <br />the General Plan and the purposes of the PUD Ordinance, that <br />Ordinance No. 1419 be introduced, to be read by title only and <br />waiving further reading thereof, approving PUD-88-17, the <br />application of Country Investors and George Ward for development <br />plan approval to construct a 23-parcel, single-family residential <br />project, to be located on an approximately 6.7 acre site located <br />at 2667 Vineyard Avenue, subject to the conditions set forth in <br />Staff Report 89:138, and the developer to provide full street <br />widening along Vineyard Avenue, including curbs, gutters, and <br />sidewalks, subject to a reimbursement agreement; and that staff, <br />the developer and the East Bay Regional Park District resolve the <br />issue of access to the Park District. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmembers Brandes and Tarver <br />ABSENT: None <br /> <br /> With regard to the amendment to the Growth Management <br />Ordinance, Councilmember Mohr stated that two other extensions <br />have been granted, setting a precedent. She felt this developer <br />should receive the same consideration. <br /> <br /> Councilmember Brandes stated he voted against the previous <br />two extensions and would be voting against this one. <br /> <br /> Mayor Mercer stated he voted for the two previous requests <br />for extension because of unusual circumstances, but he did not <br />feel the findings could be made to grant an extension in this <br />case. <br /> <br /> Councilmember Butler stated that because of City process <br />previous applications were late; however he does not see that in <br />this situation. <br /> <br /> Councilmember Tarver stated he did not agree with the first <br />exemption, the second was warranted, but this one is not. <br /> <br /> It was moved by Councilmember Brandes, and seconded by <br />Councilmember Butler, that no amendment to the Growth Management <br />Ordinance be made in connection with PUD-88-17, the application of <br />Country Investors and George Ward for development of a 23-parcel, <br />single-family residential project to be located on an <br />approximately 6.7 acre site located at 2667 Vineyard Avenue. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor <br /> Mercer <br />NOES: None <br /> <br /> ABSENT: None <br /> <br /> - 10 - 5-16-89 <br /> <br /> <br />
