Councilmember Butler indicated he was against conditioning <br />the project that way because this project meets the City's traffic <br />conditions and he doesn't understand the need to impose new <br />traffic conditions at this time. Secondly, he doesn't understand <br />why that shopping center is not an appropriate site for a drive-in <br />restaurant. <br /> <br /> It was then moved by Mayor Mercer, and seconded by <br />Councilmember Mohr, after finding that the development plan is <br />consistent with the goals and policies of the General Plan and the <br />purposes of the PUD District, that Ordinance No. 1421 be <br />introduced, to be read by title only and waiving further reading <br />thereof, approving PUD-89-6, the application of Spieker Partners <br />for Planned Unit Development rezoning and development plan <br />approval for a multi-building, approximately 118,500 sq. ft. mixed <br />use retain commercial complex to be located on an approximately <br />13.3 acre site located at the northwest corner of the intersection <br />of Rosewood Drive and Santa Rita Road, subject to the conditions <br />set forth in Staff Report 89:261, and adding a condition that <br />there be no drive-through restaurant. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mohr, and Mayor Mercer <br />NOES: Councilmembers Butler and Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br />7.
