217

Ms. Bengtson replied that the Commission would have early
meetings and take the items one at a time. If no real problems
are encountered in the process, the policies should be ready in
about two to three months.

Mr. Butler asked if bike use was not prohibited in the
meantime and if the removal of specific language in the ordinance
would affect the use of the park.

Ms. Bengtson responded that technically, the park has always
been closed. And although the specific language has been deleted,
it has not affected the status of the park.

Mr. Tarver inquired if the park would be closed to all users
until the improvements were completed.

Ms. Bengtson clarified that official city hikes still go on
at the park.

There being no further testimony, Mr. Mercer declared the
public hearing closed.

It was moved by Mr. Butler, and seconded by Mr. Brandes, that
Ordinance No. 1428 be introduced, to be read by title only and
waiving further reading thereof, approving the revisions to the
Municipal Code which pertain to recreational facilities.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Butler, Mohr, Tarver, and Mayor
Mercer
NOES: None
ABSENT: None
ABSTAIN: None

Item 6b
Application of Pleasanton Unified School District for the
proposed annexation to the City of Pleasanton of approximately 125
acres located east of Sunol Boulevard and north of Sycamore Road
Mr. Swift presented his report (SR 89:344) regarding the
matter.

Ms. Mohr informed the Council that she would not participate
in the deliberations on this item because the company she works
for is owned by Mr. Michael Harris, who lives in that area, and
therefore there could be a conflict of interests.

Mr. Mercer declared the public hearing open on the
application.

Mr. Art Dunkley, representing Castlewood Properties, Inc.,
located at 239 Main Street in Pleasanton, and property owner of
336 Sycamore Road, stated that Castlewood Properties is co-owner
of 20 acres in the proposed annexation area. It is also under a
co-annexation agreement with the Pleasanton Unified School
District to manage the effort to annex their properties and is a

-5-
8-1-89
